REGULATIONS UNDER THE WAR PRECAUTIONS ACT 1914-1916.
I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the War Precautions Act 1914-1916 to come into operation forthwith.

War Precautions (Prices) Regulations 1916.
Short title.
1 These Regulations may be cited as the War Precautions (Prices) Regulations 1916.
Definitions.
2. In these Regulations, unless the contrary intention appears—
“Commissioner” means a Commissioner appointed for the purposes of these Regulations;
“Foodstuffs” means any goods declared by the Minister by notice in the Gazette to be foodstuffs for the purposes of these Regulations;
“Necessary Commodities” means goods declared by the Minister by notice in the Gazette to be necessary commodities for the purposes of these Regulations;
“Services” means any transport services declared by the Minister by notice in the Gazette to be services for the purposes of these Regulations;
“the Board” means the Commonwealth Prices Board constituted under these Regulations; and
“the Minister” means the Minister of State for Defence.
Prices Board.
3. (1) There shall be a Commonwealth Prices Board, consisting of five members, who shall be appointed by, and shall hold their membership during the pleasure of, the Governor-General.
(2) The Chairman of the Board shall be appointed by the Governor-General, and in his absence the members present may elect one of their number to act as Chairman.
(3) The Commonwealth Prices Adjustment Board existing at the date of the making of these Regulations shall be the Commonwealth Prices Board for the purposes of these Regulations and the Chairman of that Board holding office at the date of the making of these Regulations shall be deemed to have been appointed Chairman of the Commonwealth Prices Board under these Regulations.
(4) Three members of the Board shall form a quorum.

Commissioners.
4. (1) For the purposes of these Regulations the Minister may appoint a Commissioner in each State, and in each Territory being part of the Commonwealth.
(2) It shall be the duty of each Commissioner to furnish reports and make recommendations to the Board upon such matters as are referred to him by the Board.
Expenses of members of the Board and salaries and allowances of Commissioners.
5. (1) The Chairman of the Board shall be paid a sum of Thirty shillings per diem, and the other members of the Board a sum of Twenty-five shillings per diem each, on account of expenses incurred by them in and in the course of travelling, whether by land or water, whenever such expenses have been incurred bonâ fide in the performance of their duties as members of the Board, and such sums as may be necessary to pay the cost of their conveyance.
(2) The respective Commissioners shall be paid such remuneration be way of salary and allowances as the Minister determines.
Powers of Board and Commissioners.
6. (1) The Board and each Commissioner shall, in relation to any matter as to which it or he has power to furnish a report or make a recommendation under these Regulations, have power to—
(a) summon witnesses;
(b) take evidence on oath;
(c) require the production of documents books and papers; and
(d) enter upon any premises and inspect any documents books and papers or any stocks of foodstuffs and necessary commodities, or authorize any member of the Board or any other person to enter upon any premises and inspect any such documents books and papers or any stocks of foodstuffs and necessary commodities.
(2) Each Commissioner shall have power to recommend to, the Board, and the Board shall have power to recommend to the Minister that any particular goods be declared to be foodstuffs or necessary commodities, as the case may be, within the meaning of these Regulations.
(3) If any member of the Board or any Commissioner or any other person authorized by the Board or by any Commissioner discloses, except in the course of his duty, or except to the Board, or to the Commissioner as the case may be, any information obtained by him while upon any such premises, he shall be guilty of an offence.
Failure of witness to appear.
7. Any person who, having been summoned as a witness before the Board or before any Commissioner, fails, without lawful excuse, to appear in obedience to the summons, shall be guilty of an offence.
Failure to be sworn, produce documents, or answer questions.
8. Any person who, having been summoned as a witness before the Board or before any Commissioner, refuses, without lawful excuse, to be sworn, or to make an affirmation, or to produce documents books and papers or to answer questions which he is lawfully required to answer, shall be guilty of an offence.
Preventing Board or member or Commissioner from entering premises. &c.
9. Any person who prevents or attempts to prevent the Board or any member of the Board or any Commissioner or any other person who produces an authority in writing signed by the Chairman of the Board or by any Commissioner from entering upon any premises and inspecting any documents books and papers or any stocks of foodstuffs and necessary commodities shall be guilty of an offence.
Sub-committees.
10. (1) The Board may appoint one or more sub-committees, consisting of not less than two members thereof, for the purpose of taking evidence upon any matter in relation to the prices of foodstuffs and necessary commodities and services.
(2) Any sub-committee so appointed shall have and may exercise the same as are conferred on the Board by sub-regulation (1) of Regulation 6 of these Regulations.
Minister may require returns to be furnished.
11 (1) The Board shall have power to recommend to the Minister, as regards any particular foodstuffs or necessary commodities or services, that any person or class of persons holding stocks of those foodstuffs or necessary commodities or performing those services be required to furnish returns to the Board, and the Minister, on receipt of the recommendation of the Board, may, if he thinks fit, by notice in the Gazette require that such returns as are specified by him be furnished to the Board.
(2) Any person who refuses or fails to furnish to the Board any return which he is required, in pursuance of this Regulation, to furnish shall be guilty of an offence.
Proclaimed areas.
12. (1) For the purpose of these Regulations, the areas specified in the Schedule shall, subject to sub-regulations (2) and (3) of this Regulation, be proclaimed areas.
(2) Upon the recommendation of the Board, the Minister may from time to time by notice in the Gazette declare that any area specified by him shall, for the purposes of these Regulations, be a proclaimed area or part of a proclaimed area, and thereupon the area shall, so long as the declaration remains in force, be deemed to be a proclaimed area, or part thereof, as the case may be.
(3) Upon the recommendation of the Board, the Minister may from time to time by notice in the Gazette declare that any proclaimed area, or any part thereof, shall cease to be a proclaimed area, or part thereof (as the case may be) and thereupon such area, or part, shall cease to be a proclaimed area, or part thereof (as the case may be).
Determination of prices, &c.
13. (1) The Minister may from time to time, on the recommendation of the Board—
(a) determine the maximum prices which may be charged for foodstuffs and necessary commodities sold, and the maximum rates which may be charged for services the performance of which is commenced, in any proclaimed area;
(b) determine the conditions of the sale of foodstuffs and necessary commodities sold therein, and of the performance of services the performance of which is commenced therein.
(2) Any such determination shall be published in the Gazette, and shall from the date specified in the Gazette have the force of law.
Governor-General may proclaim areas and fix prices and rates.
14. Notwithstanding anything contained in the last two preceding Regulations the Governor-General may, without any recommendation of the Board—
(a) declare any area to be a proclaimed area for the purposes of these Regulations;
(b) fix the price of foodstuffs and necessary commodities sold, and the rates for services the performance of which is commenced, in any proclaimed area; and
(c) declare that, as regards any proclaimed area, any price fixed by or under these Regulations shall, after a date specified
by him, cease to be the maximum price at which, foodstuffs and necessary commodities may be sold or offered for sale, and any rates fixed under these Regulations shall, after a date specified by him, cease to be the maximum rates which may be charged, for services the performance of which is commenced, in that area.
Contravention of prices and rates.
15. Any person who in any proclaimed area sells or offers for sale any foodstuffs and necessary commodities at a greater price than the maximum price fixed, by or under these Regulations, for the sale of those foodstuffs and necessary commodities, or charges any higher rates than the maximum rates fixed under these Regulations which may be charged for services the performance of which is commenced, in that area shall be guilty of an offence.
Receipt of freight greater than the maximum freight.
16. From and after the date of the making of these Regulations no higher rate than the rate prevailing on the eighteenth day of May, 1916, shall, unless the written consent of the Minister has first been obtained, be charged for freight on the carriage of goods from any port in Australia to any other port in Australia.
Operation of State orders &c. preserved.
17. All orders, awards, determinations and notifications made under any State Act which have the effect of fixing the maximum prices which may be charged for any goods, and which are in force at the date of the making of these Regulations, shall, so far as they are not inconsistent with any prices fixed by or under these Regulations, or by or under any Regulations repealed by these Regulations, continue in force, in the areas to which they respectively apply, as if they were orders made under these Regulations.
Price fixed to apply to sale under contracts.
18. Where the price of any goods or services has been fixed by or under these Regulations, or by or under any Regulations repealed by these Regulations, that price shall apply to—
(a) the sale or performance of all goods or services sold, or performed, after the date of the fixing of that price, in pursuance of a contract entered into before that date, unless the Minister certifies that, as regards any particular contract or class of contracts, or any part of a contract or class of contracts, it is undesirable that the price should apply, and
(b) the sale or performance of all goods or services sold or performed, after the data of the fixing of that price, in pursuance of a contract entered into after that date.
Repeal.
19. The following Regulations, that is to say—
