REGULATIONS UNDER THE WAR PRECAUTIONS ACT 1914-1916.

War Precautions (Passports) Regulations 1916—Regulations 3, 4, 5 (1) (ii), 5 (1) (iii), (6)—Amendments. Regulations 2 and 5 (1) (iii)—Additions.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the War Precautions Act 1914-1916 to come into operation forthwith, with the exception of the amendment of clause (ii) of sub-regulation (1) of regulation 5 which shall come into operation on and from the 1st day of July, One thousand nine hundred and seventeen.

War Precautions (Passports) Regulations 1916.

(Statutory Rule No. 206 of 1916, as amended by later Statutory Rules.)

1. Regulation 2 is amended by inserting the following definition:—

“Officer” means a competent naval or military authority or any person authorized by a competent naval or military authority to exercise the powers conferred on officers by those Regulations, or a member of the Police Force, or an officer of Customs.

2. Regulations 3 and 4 are amended by substituting the word “sixteen” for the word “fifteen” wherever occurring.

3. Clause (ii) of sub-regulation (1) of regulation 5 is amended (as from 1st July, 1917), to read as follows:—

“(ii) any alien member of the crew of an oversea vessel arriving in the Commonwealth who lands at any port having on his person the certificate of his registration under the War Precautions (Aliens Registration) Regulations 1916, provided that he rejoins his vessel during her stay in that port.”

4. Sub-regulation (1) of regulation 5 is amended by inserting the following new clause (iib) after clause (iia):—

“(iib) any member of the crew of an oversea vessel who lands in the Commonwealth as a result of shipwreck, or who being seriously ill lands for medical treatment, and who is exempted from being in possession of a passport by a competent naval or military authority or a person authorized to act for a competent authority;

5. Clause (iii) of sub-regulation (1) of regulation 5 is amended to read as follows:—

“(iii) any person visiting New Zealand, or leaving the Commonwealth to settle in New Zealand, if he is in possessions of a permit to visit New Zealand or to leave the Commonwealth to settle in New Zealand issued by the proper authorities in the Commonwealth, and if he travels in a vessel trading solely between the Commonwealth and New Zealand;”

6. Regulation 6 is amended to read as follows:—

“6. (1) Any person entering the Commonwealth who is required by those Regulations to be in possession of a passport shall at the first port of call give up his passport to an officer on board the vessel in which he enters the Commonwealth, unless exempted by an officer from this requirement.

(2) If allowed to retain to passport, or if the passport is returned to him at the first port of call, he shall if required by an officer give it up at any subsequent port of call.

(3) Before an alien seaman signed on outside the Commonwealth is discharged in the Commonwealth, he shall (unless exempted under clause (iib) of sub regulation (1) of regulation (5), lodge his passport with as officer authorized to receive it.

(4) Any passport of which possession is taken under the power conferred by those Regulations may be detained by any person authorized by the Minister in that behalf until the person from whom it was taken embarks from, any place in the Commonwealth.”
