REGULATIONS UNDER THE WAR PRECAUTIONS ACT 1914-16.

War Precautions (Passports) Regulations 1916—Regulation 7a.—Addition.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the War Precautions Act 1914–16 to come into operation forthwith.

War Precautions (Passports) Regulations 1916.—Addition.

War Precautions (Passports) Regulations 1916 are amended by inserting the following new regulation after regulation 7:—

Power to deport persons who enter the Commonwealth without passports.

“7a. Any person who—

(a) lands in the Commonwealth in contravention of these Regulations; or

(b) being a passenger on a vessel which enters Australian waters, is not in possession of a passport; or

(c) being a member of the crew of a vessel, and not being in possession of a passport, deserts from his vessel,

(d) being a member of the crew of a vessel, and not being in possession of a passport, in the opinion of a competent naval or military authority intends to desert his vessel,

may be required by a competent naval or military authority to leave the Commonwealth; and until he leaves he may be detained in such manner as a competent naval or military authority may direct and whilst so detained shall be deemed to be in legal custody.
