REGULATIONS UNDER THE DEFENCE ACT 1903-1956.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1956.

Amendments of the Financial (Military) Regulations.†

Commencement.

1. These regulations shall be deemed to have come into operation on the first day of July, 1960.

Definitions.

2. Regulation 4 of the Financial (Military) Regulations is amended by inserting, after the definition of “member”, the following definition:—

“‘native member’ means an aboriginal inhabitant of the Territory of Papua or the Territory of New Guinea serving in the Permanent Military Forces;”.

3. After regulation 7 of the Financial (Military) Regulations the following regulation is inserted:—

Pay of Native Members.

“7a.—(1.) Subject to this regulation, the rate of pay of a native member is the rate per month specified in relation to his rank in the Sixth Schedule to these Regulations, or where classifications and lengths of service in rank or classification are specified in that Schedule in relation to a rank, the rate per month so specified in relation to his rank, classification and length of service in the rank or classification.

“(2.) The rate of pay of a native member on enlistment who possesses such qualifications as are determined by the Military Board may be at a rate higher than the minimum rate per month specified for the rank of private in the Sixth Schedule to these Regulations but the rate shall not exceed Two pounds ten shillings per month.

“(3.) Where a native member serving on the thirtieth day of June, 1960, was in receipt of a rate of pay which exceeds the rate of pay specified in relation to his rank or in relation to his rank, classification and length of service in rank or classification in the Sixth Schedule to these Regulations he may, subject to the next succeeding sub-regulation, be paid an allowance of an amount equal to the difference.

“(4.) If, at any time, the rate of pay specified in the Sixth Schedule to these Regulations is equal to or exceeds the rate payable to a native member on the thirtieth day of June, 1960, he shall from that time cease to be eligible for any allowance under the last preceding sub-regulation.

“(5.) Twenty-five per centum of the pay payable to a native member under this regulation shall be retained as a credit in his pay account and is payable to him on completion of his engagement, re-engagement, or on termination of his service, whichever is the earlier.

“(6.) An incremental advancement in the rate of pay of a member in respect of length of service in a rank or classification shall not be granted to a member unless the member complies with such conditions as are approved by the Minister.

“(7.) A rate of pay prescribed in the Sixth Schedule to these Regulations in relation to a classification applies to such members as the Military Board designates as holding that classification for the purposes of this regulation.

“(8.) Regulations 12 to 19 (inclusive) and regulation 37 of these Regulations do not apply to or in respect of a native member.”.

4. The Financial (Military) Regulations are amended by adding at the end thereof the following Schedule:—
