Statutory Rules 1964, No. 100.(h)

 

1.—(1.) Regulation 10 of the Military Financial Regulations is repealed and the following regulation inserted in its stead:—

Consolidated rates of pay.

“10.—(1.) The rate of pay payable to the Chief of the General Staff is a consolidated rate of pay of Six thousand one hundred and fifty pounds per year.

“(2.) The rate of pay payable to a Lieutenant-General, not being the Chief of the General Staff, is a consolidated rate of pay of Five thousand four hundred pounds per year.

“(3.) The rate of pay payable to a Major-General is a consolidated rate of pay of Five thousand six hundred and twenty-five pounds per year.

“(4.) The rate of pay payable to a Brigadier is a consolidated rate of pay of Four thousand seven hundred and eighty-five pounds per year.”.

(2.) Regulation 10 of the Military Financial Regulations, as amended by these Regulations, applies to and in relation to service of a Major-General in the Permanent Military Forces on and after the twenty-sixth day of June, 1964.

(3.) The rate of pay of a Brigadier of the Permanent Military Forces, in respect of service on a day in the period from and including the twenty-sixth day of June, 1964, to and including the day immediately before the commencement of these Regulations, is increased by an amount equal to the amount by which the sum of—

(a) the pay payable to him in respect of that day under the Military Financial Regulations as in force immediately before the commencement of these Regulations; and

(h) Made under the Defence Act 1903–1956 on 30 July, 1964; notified in the Commonwealth Gazette on 31 July, 1964.


(b) the allowances (being allowances not payable to an officer in receipt of pay at a consolidated rate of pay) payable to him in respect of that day under the Military Financial Regulations as amended by these Regulations in their application in relation to service on that day,

is less than Thirteen pounds two shillings and twopence.

Members other than general officers.

2.—(1.) Regulation 11 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “next succeeding regulation” and inserting in their stead the words “next two succeeding regulations”;

(b) by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

“(3.) The rate of pay per day of an officer holding an appointment of Quartermaster, being an officer who was appointed as a Quartermaster before the twenty-sixth day of June, 1964, is—

(a) the rate of pay specified in Part A of Table 1 in relation to the rank and length of service in the rank of the officer; or

(b) the sum of the rate of pay specified in Table 3 in relation to the rank and length of service in the rank of the officer and Three shillings and fourpence,

whichever is the greater.”;

(c) by omitting from sub-regulation (4.) the words “One pound twelve shillings and elevenpence” and inserting in their stead the words “Two pounds one shilling and threepence”; and

(d) by omitting paragraph (a) of sub-regulation (15.) and inserting in its stead the following paragraph:—

“(a) where the rate of pay of a member immediately before he is appointed to commissioned rank is higher than the rate that would, but for this be applicable to the member upon that appointment, the rate of pay of the member is the next higher rate applicable to the rank to which he is appointed and, for the purpose of incremental advancement, he shall, immediately before the day as from which he is so appointed, be deemed to have completed the service in that rank entitling him to payment at that next higher rate;”.

(2.) The rate of pay applicable in accordance with sub-regulation (4.) of regulation 11 of the Military Financial Regulations is, by virtue of this sub-regulation, increased by One shilling and sixpence per day in respect of service during the period from and including the twelfth day of August, 1963, to and including the twenty-fifth day of June, 1964.

3. After regulation 12 of the Military Financial Regulations the following regulation is inserted:—

Special increase in pay.

12a.—(1.) Subject to the next succeeding sub-regulation, the rate of pay of a male member of the rank of Warrant Officer, Class 1 or of a lower rank is, by virtue of this regulation, increased by Four shillings per day.


“(2.) The last preceding sub-regulation does not apply to—

(a) a native member;

(b) an apprentice tradesman; or

(c) an apprentice musician or apprentice clerk who has not attained the age of eighteen years.”.

Marriage allowance.

4. Regulation 15 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “Eight shillings and threepence” and inserting in their stead the words “Nine shillings and sixpence”; and

(b) by omitting from sub-regulations (3.) and (5.) the words “Fourteen shillings” (wherever occurring) and inserting in their stead the words “Fifteen shillings”.

Qualifying allotment for payment of full rate of marriage allowance.

5. Regulation 18 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the words “One pound two shillings and threepence” and inserting in their stead the words “One pound four shillings and sixpence”; and

(b) by omitting from paragraph (b) of sub-regulation (1.) the words “One pound nine shillings and threepence” and inserting in their stead the words “One pound eleven shillings and sixpence”

General conditions relating to eligibility for certain allowances.

6. Regulation 23 of the Military Financial Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (a) of sub-regulation (3.) the words “Fifteen shillings and threepence” and inserting in their stead the words “Seventeen shillings”;

(b) by omitting from sub-paragraph (ii) of paragraph (a) of sub-regulation (3.) the words “One pound two shillings and threepence” and inserting in their stead the words “One pound four shillings”;

(c) by omitting from sub-paragraph (i) of paragraph (b) of sub-regulation (3.) the words “Eight shillings and threepence” and inserting in their stead the words “Nine shillings and sixpence”; and

(d) by omitting from sub-paragraph (ii) of paragraph (b) of sub-regulation (3.) the words “Fifteen shillings and threepence” and inserting in their stead the words “Sixteen shillings and sixpence”.

Special allowance for medical officers and dental officers.

7. Regulation 26 of the Military Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to the next succeeding sub-regulation, a special allowance is payable to a medical officer or a dental officer at the appropriate rate per day specified in the Fifth Schedule to these Regulations having regard to his rank and length of service in the rank.”.

Hard lying allowance.

8.—(1.) Regulation 31 of the Military Financial Regulations is amended by omitting from sub-regulation (3.) the words “Two shillings and sixpence per day or One shilling and threepence per day” and inserting in their stead the words “Three shillings and threepence per day or One shilling and ninepence per day”.

(2.) The first determination made by the Military Board for the purposes of sub-regulation (3.) of regulation 31 of the Military Financial Regulations as amended by these Regulations takes effect as if it had been made on the twenty-sixth day of June, 1964.


Disturbance allowance on removal.

9. Regulation 122 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (b) of sub-regulation (2.) the words “Thirty pounds” and inserting in their stead the words “Thirty-seven pounds ten shillings”; and

(b) by omitting from paragraph (c) of sub-regulation (2.) the words “Forty pounds” and inserting in their stead the words “Fifty pounds”.

10. After regulation 172 of the Military Financial Regulations the following regulation is inserted:—

Special increase in pay.

“172a.—(1.) Subject to the next succeeding sub-regulation, the rate of pay of a male member of the rank of Warrant Officer, Class 1 or of a lower rank is, by virtue of this regulation, increased by Four shillings per day.

“(2.) The last preceding sub-regulation does not apply to a member of the Papua and New Guinea Volunteer Rifles who is not included in a class of such members determined by the Military Board to be a class to which regulation 178a of these Regulations applies.”.

Marriage allowance.

11. Regulation 177 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “Eight shillings and threepence” and inserting in their stead the words “Nine shillings and sixpence”.

Special allowance for medical officers and dental officers.

12. Regulation 180 of the Military Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to the next succeeding sub-regulation, a special allowance is payable to a medical officer or a dental officer of the Citizen Military Forces at the rate per day specified in the following table opposite to the rank of the officer:—

Hard-lying allowance.

13.—(1.) Regulation 184 of the Military Financial Regulations is amended by omitting from sub-regulation (3.) the words “Two shillings and sixpence per day or One shilling and threepence per day” and inserting in their stead the words “Three shillings and threepence per day or One shilling and ninepence per day”.

(2.) The first determination made by the Military Board for the purposes of sub-regulation (3.) of regulation 184 of the Military Financial Regulations as amended by these Regulations takes effect as if it had been made on the first day of July, 1964.

Marriage allowance.

14. Regulation 202 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “Eight shillings and threepence” and inserting in their stead the words “Nine shillings and sixpence”.

Clothing maintenance allowance.

15. Regulation 214 of the Military Financial Regulations is amended by omitting the words “Two shillings and sixpence” and inserting in their stead the words “Two shillings and ninepence”.


Supplementary ration allowance.

16.—(1.) Regulation 218 of the Military Financial Regulations is amended by omitting the words “Fourpence halfpenny” and inserting in their stead the figures and words “5.25 pence”.

(2.) The amendment effected by the last preceding sub-regulation applies in relation to supplementary ration allowance in respect of the first day of July, 1964, and subsequent days.

Living out allowance—unmarried members.

17. Regulation 223 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “Nine shillings and ninepence” and inserting in their stead the words “Ten shillings and threepence”.

Retention of lodgings allowance—P.M.F.

18. Regulation 227 of the Military Financial Regulations is amended by omitting from paragraph (a) of sub-regulation (4.) the words “Nine shillings and ninepence” and inserting in their stead the words “Ten shillings and threepence”.

Retention of lodgings allowance—C.M.F.

19. Regulation 228 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “Nine shillings and ninepence” and inserting in their stead the words “Ten shillings and threepence”.

20.—(1.) The Second Schedule to the Military Financial Regulations is amended by omitting Tables 1 and 2 and inserting in their stead the following Tables:—

Application.

23.—(1.) Subject to sub-regulation (4.) of this regulation, the amendments of the Military Financial Regulations effected by sub-regulation (1.) of regulation 2, regulations 3, 4, 5 and 6, sub-regulation (1.) of regulation 8 and regulations 9, 15, 17, 18 and 20 of these Regulations apply in relation to service in the Permanent Military Forces on and after the twenty-sixth day of June, 1964.

(2.) Subject to sub-regulation (4.) of this regulation, the amendments of the Military Financial Regulations effected by regulations 10 and 11, sub-regulation (1.) of regulation 13 and regulations 19 and 21 of these Regulations apply in relation to service in the Citizen Military Forces on and after the first day of July, 1964.

(3.) The amendment of regulation 202 of the Military Financial Regulations effected by regulation 14 of these Regulations applies in relation to service in the Australian Cadet Corps on and after the first day of July, 1964.

(4.) The amendments of the Military Financial Regulations effected by regulations 20 and 21 of these Regulations do not apply in relation to service of a medical officer or a dental officer before the commencement of this regulation.

(5.) The rate of pay that would, but for this sub-regulation, be the rate of pay for a medical officer or a dental officer—

(a) in respect of service in the Permanent Military Forces on a day in the period from and including the twenty-sixth day of June, 1964, to and including the day immediately before the commencement of this regulation; or

(b) in respect of service in the Citizen Military Forces on a day in the period from and including the first day of July, 1964, to and including the day immediately before the commencement of this regulation,

is increased by the amount by which the sum of the pay of the officer in respect of that day under the Military Financial Regulations as in force on that day and the allowance payable in respect of that day by virtue of regulation 26 or 180, as the case requires, of the Military Financial Regulations as so in force is less than that sum would have been if the the amendments effected by these Regulations had been in force on that day.

(6.) Where, but for this sub-regulation, a male member would, by virtue of the application of the amendments of sub-regulation (3.) or (5.) of regulation 15 of the Military Financial Regulations as from the twenty-sixth day of June, 1964, in accordance with sub-regulation (1.) of this regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance, or the rate of marriage allowance shall not be reduced, as the case may be, until the date of commencement of these Regulations.

(7.) Where an allotment made by a male member was in force in respect of the period from and including the twenty-sixth day of June, 1964, to and including the day immediately before the commencement of these Regulations, or in respect of any part of that period, at a rate that entitled him to marriage allowance at the rate of Eight shillings and threepence per day but would not entitle him to marriage allowance at the rate of Nine


shillings and sixpence per day under the Military Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or part of the period, as the case may be, and, if he does so, marriage allowance is payable in accordance with the Military Financial Regulations as amended by these Regulations as if his increased allotment had been in force during the period or part of the period.
