Parts.

1. Regulation 4 of the Military Financial Regulations is amended by inserting after the words—

“Division 15.—Miscellaneous Allowances and Payments (Regulations 165-169).”

the words—

“ Part IIa.—Regular Army Emergency Reserve (Regulations 169A-169H).”.

Definition.

2. Regulation 9 of the Military Financial Regulations is amended by omitting the words “ Regular Army Special Reserve” (wherever occurring) and inserting in their stead the words “ Regular Army Supplement”.

Members other than general officers.

3. Regulation 11 of the Military Financial Regulations is amended by omitting from sub-regulation (4.) the words “ Regular Army Special Reserve” and inserting in their stead the words “ Regular Army Supplement”.

Special allowance for medical officers and dental officers.

4. Regulation 26 of the Military Financial Regulations is amended by omitting from sub-regulation (2.) the words “ Regular Army Special Reserve” and inserting in their stead the words “ Regular Army Supplement”.

5. Regulation 33 of the Military Financial Regulations is repealed and the following regulation inserted in its stead:—

Linguists bounty.

“33.—(1.) Subject to sub-regulation (3.) of this regulation, an allowance, called ‘linguists bounty’, is payable to a member who attains the approved standard of proficiency in an approved foreign language.

“(2.) The amount of linguists bounty payable to a member under the last preceding sub-regulation in respect of each year of service after he attains the approved standard of proficiency in an approved foreign language is—

(a) if the member has attained the approved standard of proficiency in one approved foreign language—Fifty pounds; or

(b) if the member has attained the approved standard of proficiency in more than one approved foreign language—One hundred pounds.

“(3.) Linguists bounty is not payable to a member in respect of a language unless he maintains such a standard of proficiency in the language as the Military Board approves.

“(4.) In this regulation—

‘ approved foreign language” means a language other than the English language approved by the Military Board for the purposes of this regulation;

‘approved standard of proficiency’, in relation to an approved foreign language, means such a standard of proficiency in the language as the Military Board approves.”.

6. Regulation 49 of the Military Financial Regulations is repealed and the following regulation inserted in its stead:—

Meaning of war service.

“49. For the purposes of the last three preceding regulations, ‘war service’ means Malayan service within the meaning of the Repatriation (Far East Strategic Reserve) Act 1956-1964 or special service within the meaning of the Repatriation (Special Overseas Service) Act 1962-1964.”.

Oratutity— soldiers A.R.A, and R.A.S.

7. Regulation 61 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “Regular Army Special Reserve” and inserting in their stead the words “ Regular Army Supplement”.

Gratuity not payable in certain cases.

8. Regulation 64 of the Military Financial Regulations is amended by adding at the end of paragraph (e) the words “ or Regular Army Supplement”.

Application.

9. Regulation 102 of the Military Financial Regulations is amended by omitting from paragraph (a) the words “Regular Army Special Reserve” and inserting in their stead the words “ Regular Army Supplement”.


Rates of pay.

10. After regulation 169 of the Military Financial Regulations the following part is inserted:—

“ Part IIa.—Regular Army Emergency Reserve.

“169a.—(1.) Subject to the succeeding provisions of this regulation, the rate of pay of a member of the Regular Army Emergency Reserve in respect of military service rendered in accordance with the Act is the rate of pay specified, in relation to a member of the Australian Regular Army having the like rank, classification and service in the rank as the member has, in Table 1 in the Second Schedule to these Regulations.

“(2.) Incremental advancement in the rate of pay of a member of the Regular Army Emergency Reserve, in respect of length of service in a rank or classification, is subject to the like conditions as are approved by the Military Board for the purposes of regulation 11 of these Regulations.

“(3.) For the purposes of sub-regulation (1.) of this regulation, the Military Board may designate the classification, if any, held by a member of the Regular Army Emergency Reserve.

“(4.) The service of a member of the Regular Army Emergency Reserve for the purposes of pay shall be deemed to include—

(a) the whole of the day on which the member is directed under the Act to commence a period of military service or, if the member does not commence military service until after thai day, the whole of the day on which he does commence a period of military service in pursuance of such a direction, whichever is the later day; and

(b) the whole of the last day of a period of military service.

“(5.) The length of service of a member of the Regular Army Emergency Reserve in a rank, for the purposes of pay, shall be calculated in the manner determined by the Military Board, and may include a period of service in the like rank in a force other than the Regular Army Emergency Reserve.

Allowances.

“169b.—(1.) Except as expressly provided by this Part, where a member of the Regular Army Emergency Reserve is serving on continuous full time military service, the allowances provided for in Part II. of these Regulations for a member of the Australian Regular Army having the like rank are payable to him subject to the like conditions.

“(2.) Where a member of the Regular Army Emergency Reserve is rendering continuous full time military service under sub-regulation (4.) of section 45 of the Act and the period for which he is bound to serve is less than twelve months, the member is entitled to be paid the following allowances in respect of that service at such rates and subject to such conditions as the Military Board determines:—

(a) marriage allowance;

(b) separation allowance; and

(c) provision allowance.

“(3.) A member of the Regular Army Emergency Reserve may be paid, in respect of military service rendered under sub-section (3.) of section 45 of the Act, marriage allowance, separation allowance and provision allowance at such rates and in accordance with such conditions as the Military Board determines.


Absence on account of illness or injury.

“169c. Where a member of the Regular Army Emergency Reserve who is rendering continuous full time military service under sub-section (4.) of section 45 of the Act and is bound to serve for a period of less than twelve months is absent from duty on account of illness or injury, the member is entitled to pay and allowances in respect of such period of the absence, and subject to such conditions, as the Military Board determines, and not otherwise.

Linguists bounty.

“169d.—(1.) Subject to the next succeeding sub-regulation, an allowance, called ‘ linguists bounty”, is payable to a member of the Regular Army Emergency Reserve who has attained the approved standard of proficiency in an approved foreign language.

“(2.) Linguists bounty is not payable to a member in respect of an approved foreign language unless he maintains such a standard of proficiency in the language as the Military Board approves.

“(3.) The amount of linguists bounty payable to a member in respect of each year of service in the Regular Army Emergency Reserve after he attains the approved standard of proficiency in an approved foreign language is—

(a) if the member has attained the approved standard of proficiency in one approved foreign language—Fifty pounds; or

(b) if the member has attained the approved standard of proficiency in more than one approved foreign langauge—One hundred pounds.

“(4.) Where a member has served in the Australian Regular Army or in the Regular Army Supplement for a period in respect of which linguists bounty would have been payable to him but for the fact that it was a period of less than one year, that period shall be taken to be a period of service in the Regular Army Emergency Reserve for the purposes of this regulation.

“(5.) In this regulation, references to a year of a service, in relation to a member, shall be read as references to a period of twelve consecutive months’ full time military service in the Regular Army Emergency Reserve rendered by the member under the Act or to periods of such military service so rendered amounting in the aggregate to a period of three hundred and sixty-five days.

“(6.) Linguists bounty is not payable to a member of the Regular Army Emergency Reserve under regulation 33 of these Regulations.

“(7.) In this regulation—

‘ approved foreign language’ means a language other than the English language approved by the Military Board for the purposes of regulation 33 of these Regulations;

‘approved standard of proficiency’, in relation to an approved foreign language, means such a standard of proficiency in the language as the Military Board approves.


Locum tenens allowance.

“169e.—(1.) Where a medical officer, a dental officer or a pharmaceutical officer of the Regular Army Emergency Reserve employs a locum tenens during a period during which the officer is rendering military service under the Act, an allowance, called ‘ locum tenens allowance’, is payable to the officer—

(a) if the officer is a medical officer or a dental officer—at the rate of Seven pounds seven shillings per day; or

(b) if the officer is a pharmaceutical officer—at the rate of Five pounds five shillings per day.

“(2.) Where, in a financial year, an officer referred to in the last preceding sub-regulation has attended a military school or course or a bivouac for a period of, or for periods amounting in the aggregate to, ten days or more, locum tenens allowance is not payable to the officer in respect of any further attendance at such a school, course or bivouac during the financial year.

Bounty payable to member of Regular Army Emergency Reserve.

“169f.—(i.) Subject to such conditions as the Military Board determines, a bounty is payable to a member of the Regular Army Emergency Reserve, in accordance with the following scale, in respect of his service in that force:—

On completion of one year’s service—One hundred pounds.

On completion of two years’ service—One hundred and twenty-five pounds.

On completion of three years’ service—One hundred and fifty pounds.

On completion of four years’ service—One hundred and seventy-five pounds.

On completion of each year’s service subsequent to four years’ service—One hundred and seventy-five pounds.

“(2.) Where a member of the Regular Army Emergency Reserve ceases to be such a member upon the completion of—

(a) a period of service that is less than one year;

(b) one year’s service and a further period of service that is less than one year; or

(c) two or more years’ service and a further period of service that is less than one year,

the member may be paid a bounty, in respect of the period or further period of that service that is less than one year, in such circumstances, subject to such conditions, and of such amount as the Military Board determines.

“(3.) For the purpose of calculating the bounty payable to a member of the Regular Army Emergency Reserve under this regulation, the service of a member in that force commences on the day on which he becomes a member of that force, or, if he becomes a member of that force on two or more occasions, on the day on which he last becomes such a member.

“(4.) Where a person who has previously been a member of the Regular Army Emergency Reserve again becomes such a member on the day immediately following the day on which he ceased to be such a member, the person is not, by reason only of those facts, a person who becomes a member of that force on two occasions.

Gratuity for members of Regular Army Emergency Reserve.

“169g. Where a member of the Regular Army Emergency Reserve commences to render continuous full time military service by reason of that force or a part of that force having been called out for continuous service under section 46 of the Act, a gratuity of Fifty-five pounds is payable to the member.

Application of certain provisions of Part II.

“169h. The provisions of Division 4 and Divisions 9 to 15 (inclusive) of Part II. of these Regulations apply, except to the extent to which they are inconsistent with the preceding provisions of this Part, to and in relation to the serivce of a member of the Regular Army Emergency Reserve under the Act as if that service were service of a member of the Australian Regular Army having the like rank or classification, and service in the rank or classification, as the member has.”.

Replacement of clothing.

11. Regulation 212 of the Military Financial Regulations is amended by inserting after paragraph (b) of sub-regulation (1.) the following paragraph:—

(ba) a member of the Regular Army Emergency Reserve;”.

Clothing maintenance allowance.

12. Regulation 214 of the Military Financial Regulations is amended by inserting after paragraph (a) of sub-regulation (2.) the following paragraph:—

(ad) a member of the Regular Army Emergency Reserve;”.

Retention of lodgings allowance— Permanent Military Forces other than Regular Army Emergency Reserve.

13. Regulation 227 of the Military Financial Regulations is amended by omitting sub-regulation (6.) and inserting in its stead the following sub-regulation:—

“ (6.) This regulation applies to a member of the Permanent Military Forces other than—

(a) a member to whom living out allowance or living away from home allowance is payable; or

(b) a member of the Regular Army Emergency Reserve.”.

Retention of lodgings allowance-Regular Army Emergency Reserve and Citizen Military Forces.

14. Regulation 228 of the Military Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to the succeeding provisions of this regulation and to such conditions as the Military Board determines, where a member of the Regular Army Emergency Reserve or of the Citizen Military Forces is absent from his lodgings while rendering continuous full time military service or any other military service for a period in excess of twenty-four hours and pays for the retention of his lodgings for the period of that absence, an allowance, called ‘ retention of lodgings allowance’, is payable to the member at the rate of Ten shillings and threepence per day or at the rate per day at which the member is required to pay for the retention of the lodgings, whichever is the less.”.


Funerals.

15. Regulation 245 of the Military Financial Regulations is amended—

(a) by adding at the end of paragraph (a) of sub-regulation (1.) the words “ other than a member of the Regular Army Emergency Reserve “; and

(b) by inserting in paragraph (b) of that sub-regulation, after the word “ Forces”, the word “ or of the Regular Army Emergency Reserve “.

First Schedule,

16. The First Schedule to the Military Financial Regulations is amended—

(a) by omitting the words and figures—

“Sub-regulation (1.) of Regulation 33.”

and inserting in their stead the words and figures—

“Sub-regulation (4.) of Regulation 33.”; and

(b) by inserting after the word and figures—

“Regulation 168.”

the words and figures—

“ Sub-regulations (2.) and (3.) of Regulation 169b.
