REGULATIONS UNDER THE DAIRY PRODUCE ACT 1924.*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Dairy Produce Act 1924.

DAIRY PRODUCE REGULATIONS

Citation.

1. These Regulations may be cited as the Dairy Produce Regulations.

Commencement.

2. These Regulations shall come into operation on 1 July 1977.

Interpretation.

3. In these Regulations, “ the Act ” means the Dairy Produce Act 1924.

Prescribed product for purposes of definition of “ dairy produce ”.

4. (1) For the purposes of the definition of “ dairy produce ” in section 3 of the Act, whole milk powder is prescribed.

(2) In sub-regulation (1), “ whole milk powder ” has the same meaning as in the Dairy Industry Stabilization Levy Act 1977.

Section 20aa of the Act not to apply in relation to certain classes of dairy products.

5. Section 20aa of the Act does not apply in relation to dairy products of any of the following classes:—

(a) processed butteroil produced from butter that was produced before 1 July 1977;

(b) processed cheese produced from cheese that was produced before 1 July 1977;

(c) whole milk powder produced before 1 July 1978.

Pools to be set up and maintained.

6. (1) For the purposes of sub-section 20ab (2) of the Act, a pool shall be set up in respect of dairy products of each of the kinds specified in the Schedule that are produced during a production period.

(2) A pool shall be maintained in accordance with the accounting principles generally applied in commercial practice.
