STATES GRANTS (UNIVERSITIES) ACT 1975

An Act to amend the States Grants (Universities) Act 1972-1974.

BE IT ENACTED by the Queen, the Senate and the House of Representatives of Australia, as follows:

Short title and citation.

1. (1) This Act may be cited as the States Grants (Universities) Act 1975.

(2) The States Grants (Universities) Act 1972-1974 is in this Act referred to as the Principal Act.

(3) The Principal Act, as amended by this Act, may be cited as the States Grants (Universities) Act 1972-1975.

Commencement.

2. This Act shall come into operation on the day on which it receives the Royal Assent.

Salary rates.

3. Section 4 of the Principal Act is amended—

(a) by omitting sub-section (1) and substituting the following sub-section:—

“(1) For the purposes of financial assistance under this Act—

(a) the approved rate of basic professorial remuneration is $22,750 per annum;

(b) the approved rate of remuneration for an associate professor or a reader is $19,500 per annum;

(c) the approved maximum rate of remuneration for a senior lecturer is $17,900 per annum;

(d) the approved minimum rate of remuneration for a senior lecturer is $15,400 per annum;

(e) the approved maximum rate of remuneration for a lecturer is $15,100 per annum;

(f) the approved minimum rate of remuneration for a lecturer is $11,250 per annum;

(g) the approved maximum rate of remuneration for a principal tutor is $14,000 per annum;

(h) the approved minimum rate of remuneration for a principal tutor is $11,250 per annum;

(i) the approved maximum rate of remuneration for a senior tutor or senior demonstrator is $11,250 per annum;

(j) the approved minimum rate of remuneration for a senior tutor or a senior demonstrator is $9,750 per annum;

(k) the approved maximum rate of remuneration for a tutor or demonstrator is $9,500 per annum; and

(l) the approved minimum rate of remuneration for a tutor or demonstrator is $8,000 per annum.”; and

(b) by omitting from sub-section (2) the words “after the date of commencement of the States Grants (Universities) Act (No. 2) 1974” and substituting the words “on or after 16 October 1974”.

Grants for expenditure on University building projects, &c.

4. Section 5 of the Principal Act is amended–

(a) by omitting from sub-section (1c) the figures “$1,800,000” and substituting the figures “$2,179,000”;

(b) by inserting after sub-section (1e) the following sub-section:–

“(1f) There is payable to the State of Victoria, during the year 1975, for the purpose of financial assistance in relation to a project of Deakin University, being a project to erect an Arts building, an amount of $720,000.”; and

(c) by omitting from sub-section (4) the words “under sub-section (1), (1c) or (1d)” and substituting the words “under sub-section (1), (1c), (1d) or (1f)”.


Additional grants for cost increases–University building projects, &c.

5. Section 5a of the Principal Act is amended–

(a) by inserting after sub-section (2) the following sub-sections:–

“(2A) Subject to this section, where the cost of a project of a University, being a project in respect of which an amount is payable under sub-section (1), exceeds, or appears to the Minister likely to exceed, the sum of–

(a) the sum referred to in paragraph (b) of sub-section (1); and

(b) the additional amount payable in respect of that project under sub-section (1),

there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to that project, in addition to the amounts payable in respect of the project under section 5 and sub-section (1), such amount as the Minister determines, not exceeding the amount of the excess or the likely excess.

“(2b) Amounts determined by the Minister under sub-section (2a) shall not, in the aggregate, exceed $14,732,928.”; and

(b) by omitting from sub-section (3) the words “under sub-section (1)” and substituting the words “under this section”.

Grants for equipment.

6. Section 6 of the Principal Act is amended–

(a) by inserting in sub-section (1), after the words “specified in”, the words “Part I of”;

(b) by inserting in sub-section (3a), after the words “specified in”, the words “Part I of”;

(c) by omitting from sub-section (3a) the words “that Schedule” and substituting the words “that Part”; and

(d) by inserting in sub-section (4), after the words “that University in”, the words “Part I of”.

7. After section 6 of the Principal Act the following section is inserted:–

Additional grants for cost increases–equipment.

“6a. (1) Subject to this section, where the expenditure incurred, or to be incurred, by a University specified in the Third Schedule in accordance with proposals approved under section 6 exceeds, or appears to the Minister likely to exceed, 120 per centum of the amount specified in Part I of that Schedule in relation to that University, there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to those proposals, in addition to the amount payable in respect of those proposals under section 6, such amount or amounts as the Commission determines, not exceeding the amount of the excess or the likely excess.

“(2) The Commission may approve, subject to such conditions as the Commission determines, proposals, submitted to it by a University under sub-section (1) of section 6, not being proposals approved by the Commission under sub-section (2) of that section.

“(3) Where the Commission approves a proposal in accordance with sub-section (2), there is payable under this section to the State in which the University is situated, for the purpose of financial assistance, such amount as the Commission determines.

“(4) Amounts determined by the Commission under this section in respect of a University shall not exceed the amount specified in relation to that University in Part II of the Third Schedule.

“(5) The financial assistance to a State by way of payment of an amount under this section in relation to a proposal of a University is granted on the conditions that–

(a) the State will, without undue delay, pay the amount to the University; and

(b) the State will ensure that the amount so paid to the University is applied by the University, without undue delay, for purposes of expenditure in accordance with an approval under section 6 or sub-section (2).”.


Special research grants.

8. Section 7 of the Principal Act is amended–

(a) by inserting in sub-section (1), after the words “specified in”, the words ‘‘Part I of”.

(b) by inserting in sub-paragraph (i) of paragraph (a) of sub-section (1a), after the words “specified in”, the words “Part I of”;

(c) by omitting from paragraph (b) of sub-section (1a) the words “that Schedule” and substituting the words “that Part”; and

(d) by inserting in sub-section (2), after the words “that University in, the words ‘‘Part I of.

9. After section 7 of the Principal Act the following section is inserted:–

Additional special research grants.

“7a. (1) Subject to this section, where the expenditure incurred, or to be incurred, during the period of 3 years to which this Act applies, by a University specified in the Fourth Schedule by way of additional research expenses exceeds, or appears to the Minister likely to exceed, 120 per centum of the amount specified in Part I of that Schedule in relation to that University, there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to those expenses, in addition to the amount payable in respect of those expenses under section 7, such amount or amounts as the Commission determines, not exceeding, in the aggregate

(a) the amount of the excess or the likely excess; or

(b) the amount specified in relation to that University in Part II of that Schedule,

whichever is the less.

“(2) The financial assistance to a State by way of payment of an amount under sub-section (1) in relation to any expenses of a University is granted on the conditions that–

(a) the State will, without undue delay, pay the amount to the University; and

(b) the State will ensure that the University promptly discharges any outstanding liability in respect of those expenses.”.

Building grants in respect of halls of residence and residential colleges.

10. Section 8 of the Principal Act is amended

(a) by omitting from sub-section (4) the words “under this section” and substituting the words ‘‘under sub-section (2)”;

(b) by omitting from sub-section (4) all of the words from and including the word “determine” and substituting the words “determine that the first-mentioned amount be reduced by an amount determined by the Commission, not being an amount exceeding the amount specified in the certificate of the Minister, and, upon the making of such a determination, the first-mentioned amount shall, for the purposes of this section, be deemed to be so reduced accordingly.”;

(c) by inserting after sub-section (4) the following sub-sections:—

“(4a) Subject to this section, there may be added to the amount payable to a State under sub-section (2) in respect of expenditure by a University in carrying out a project of a hall of residence or of a residential college, such amount or amounts as the Commission determines, not exceeding, in the aggregate—

(a) in the case of expenditure in carrying out a project of a hall of residence–the excess (if any) of the cost of the project over an amount equal to 120 per centum of the amount payable under sub-section (2) in relation to that project; or

(b) in the case of expenditure in carrying out a project of a residential college–the lesser of—

(i) the excess (if any) of the cost of the project over an amount equal to 150 per centum of the amount payable under sub-section (2) in relation to that project; or

(ii) an amount equal to 300 per centum of an amount derived otherwise than in consequence of the grant of financial assistance by Australia to the State in which the relevant University is situated that was, or is to be, expended by the body administering the residential college in relation to that project, not being such an amount that has been taken into account, or is to be taken into account, for the purposes of sub-section (2).


“(4b) Subject to this section, if, during the year 1975, in respect of a project of a hall of residence or a residential college, not being a project in respect of which a grant of financial assistance has been made under sub-section (2), the Minister has, at the request of the State in which the relevant University is situated, approved the grant of financial assistance in respect of the project, there is payable to that State, for the purpose of financial assistance, such amount as the Commission approves, not exceeding, in the case of a project of a residential college, an amount equal to 300 per centum of an amount derived otherwise than in consequence of the grant of financial assistance by Australia to the State in which the relevant University is situated that was, or is to be, expended by the body administering the residential college in relation to that project.

“(4c) Amounts determined by the Commission under sub-sections (4a) and (4b) shall not, in the aggregate, exceed the sum of the amounts by which the amounts specified in a column of the Fifth Schedule are deemed, by virtue of sub-section (4), to have been reduced.”; and

(d) by inserting in sub-section (5), after the words “under sub-section (2)”, the words“, (4a) or (4b)”.

Additional grants for cost increases–building projects of halls and colleges.

11. Section 8a of the Principal Act is amended—

(a) by omitting from sub-section (3) the word “Thirtieth” and substituting the word “Thirteenth”;

(b) by inserting after sub-section (4) the following sub-section:–

“(4a) Subject to this section, where it appears to the Minister that, by reason of increases in the cost of projects of halls of residence or residential colleges of a University, being projects of the kind referred to in paragraph (b) of sub-section (2), the amount that may be paid under section 8 in respect of those projects, together with the amounts (if any) payable under sub-section (2) in respect of those projects, should be supplemented, there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to those projects, in addition to those amounts, such further amount as the Minister determines.

“(4b) Amounts determined by the Minister under sub-section (4a) shall, not in the aggregate exceed $972,848.”; and

(c) by inserting in sub-section (5), after the words “sub-section (2)”, the words “or 4a”.

Additional grants for cost increases–teaching hospital building projects.

12. Section 10a of the Principal Act is amended–

(a) by inserting after sub-section (2) the following sub-sections:–

“(2a) Subject to this section, where the cost of a teaching hospital project of a University, being a project in respect of which an amount is payable under sub-section (1), exceeds, or appears to the Minister likely to exceed, the sum of–

(a) the sum referred to in paragraph (b) of sub-section (1); and

(b) the additional amount payable in respect of that project under sub-section (1),

there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to that project, in addition to the amounts payable in respect of the project under section 10 and sub-section (1), such amount as the Minister determines, not exceeding the amount of excess or the likely excess.

“(2b) Amounts determined by the Minister under sub-section (2a) shall not, in the aggregate, exceed $751,360.”; and

(b) by omitting from sub-section (3) the words “under sub-section (1)” and substituting the words “under this section.
