An Act to amend the Ministers of State Act 1952 and other legislation in relation to Parliamentary Secretaries, and for other purposes

[Assented to 29 February 2000]

The Parliament of Australia enacts:

1  Short title

  This Act may be cited as the Ministers of State and Other Legislation Amendment Act 2000.

2  Commencement

 (1) Subject to subsection (2), this Act commences on a day to be fixed by Proclamation.

 (2) If this Act does not commence under subsection (1) within the period of 6 months beginning on the day on which it receives the Royal Assent, it commences on the first day after the end of that period.

3  Schedule(s)

  Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.


Schedule 1Amendment of the Ministers of State Act 1952

 

1  Section 4

Repeal the section, substitute:

4  Number of Ministers

  The number of the Ministers of State must not exceed:

 (a) in the case of those designated, when appointed by the GovernorGeneral, as Parliamentary Secretary—12; and

 (b) in the case of those not so designated—30.

2  Section 5

Omit “$1,622,000”, substitute “$2,300,000”.


Schedule 2Repeal of the Parliamentary Secretaries Act 1980

 

1  The whole of the Act

Repeal the Act.

2  Saving of amendments

The repeal of the Parliamentary Secretaries Act 1980 does not affect the amendments made by section 5 of that Act.

Note: However, some of the amendments are affected by Schedule 3 to this Act.


Schedule 3Amendment of the Remuneration Tribunal Act 1973

 

1  Paragraph 3(4)(jb)

Repeal the paragraph.

2  Subsection 7(1A)

Repeal the subsection.

3  Subsection 7(9)

Omit “(other than a determination under subsection (1A))”.

4  Paragraph 8(1)(b)

Omit “(1A),”.

5  Subsection 8(1A)

Repeal the subsection.


Schedule 4Amendment of the Freedom of Information Act 1982

 

1  Subsection 4(1) (definition of Minister)

Repeal the definition.
