HANDICAPPED PERSONS ASSISTANCE AMENDMENT ACT 1976

An Act to amend the Handicapped Persons Assistance Act 1974 to increase the Handicapped Children’s Benefit, and with respect to certain formal matters.

BE IT ENACTED by the Queen, and the Senate and House of Representatives of the Commonwealth of Australia, as follows:—

Short title, &c.

1. (1) This Act may be cited as the Handicapped Persons Assistance Amendment Act 1976.

(2) The Handicapped Persons Assistance Act 1974 is in this Act referred to as the Principal Act.

Commencement.

2. This Act shall come into operation on 1 November 1976.

Handicapped childrens benefit.

3. (1) Section 23 of the Principal Act is amended by omitting from sub-section (1) the words “$3.50 for each day after the commencement of this Part” and substituting the words “$5.00 for each day”.

(2) Notwithstanding the amendment of the Principal Act made by sub-section (1), section 23 of that Act as in force immediately before the commencement of this Act continues to apply in respect of each day after the commencement of Part VII of that Act and before 1 November 1976.

Formal amendments.

4. The Principal Act is amended as set out in the Schedule.

FORMAL AMENDMENTS

The title to, and the following provisions of, the Principal Act are amended by omitting the word “Australia” (wherever occurring) and substituting the words “the Commonwealth”:—

Sections 3 (definitions of “eligible organization” and “government authority”), 10(1) and (3), 13(1), 15(1), 18(1) and (4) and 31(3).
