Remuneration and Allowances Amendment Act 1983

An Act relating to certain remuneration and allowances

[Assented to 22 December 1983]

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:

PART I—PRELIMINARY

Short title

1. This Act may be cited as the Remuneration and Allowances Amendment Act 1983.

Commencement

2. (1) Subject to this section, this Act shall come into operation on the day on which it receives the Royal Assent.

(2) Sub-section 5 (2) shall come into operation on the day on which section 15 of the Public Service Acts Amendment Act 1982 comes into operation.

(3) The amendments made by Part II shall be deemed to have taken effect on 6 October 1983.


PART II—AMENDMENTS OF THE REMUNERATION AND ALLOWANCES ACT 1973

Principal Act

3. The Remuneration and Allowances Act 19731 is in this Part referred to as the Principal Act.

Travelling allowances payable to the Chief Justice and Justices of the High Court

4. Section 13a of the Principal Act is amended—

(a) by omitting from sub-paragraph (4) (a) (i) $120 and $85 and substituting $130 and $95, respectively; and

(b) by omitting from sub-paragraph (4) (a) (ii) and from paragraph (4) (b) $27 and substituting $29.

Travelling allowances payable to holders of certain offices

5. (1) Section 13c of the Principal Act is amended—

(a) by omitting from sub-paragraph (4) (a) (i) $110 and $80 and substituting $120 and $90, respectively; and

(b) by omitting from sub-paragraph (4) (a) (ii) and from paragraph (4) (b) $27 and substituting $29.

(2) Section 13c of the Principal Act is amended by omitting from sub-section (5) officers of the First Division of the Australian Public Service and substituting the holders of offices referred to in paragraph (a) of the definition of office of Permanent Head in sub-section 7 (1) of the Public Service Act 1922.

Schedule 3

6. Schedule 3 to the Principal Act is repealed and the following Schedule is substituted:

PART III—AMENDMENT OF THE MINISTERS OF STATE ACT 1952

Principal Act

7. The Ministers of State Act 19522 is in this Part referred to as the Principal Act.

Salaries of Ministers

8. Section 5 of the Principal Act is amended by omitting $575,000 and substituting $590,000.

PART IV—AMENDMENTS OF THE REMUNERATION TRIBUNALS ACT 1973

Principal Act

9. The Remuneration Tribunals Act 19733 is in this Part referred to as the Principal Act.

Time of making reports and determinations

10. Section 8 of the Principal Act is amended—

(a) by omitting paragraph (2) (a) and substituting the following paragraphs:

(a) an office came into existence before the commencement of the Remuneration and Allowances Amendment Act 1983 and the Tribunal has not determined the remuneration to be paid in respect of that office;

(aa) an office comes into existence after that commencement; or;

(b) by omitting from sub-section (2) to the holder of that office and substituting in respect of that office; and

(c) by omitting from sub-section (3) to the holder of an office and substituting in respect of an office.
