Australian Capital Territory Government Service (Consequential Provisions) Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Australian Capital Territory Government Service (Consequential Provisions) Act 1994.

Citation

 1. These Regulations may be cited as the Australian Capital Territory Government Service (Consequential Provisions) Regulations.

Commencement

 2. These Regulations are taken to have commenced on 1 July 1995.

Subsection 27 (3)—modification of the Australian Capital Territory Government Service (Consequential Provisions) Act 1994.

 3. The Australian Capital Territory Government Service (Consequential Provisions) Act 1994 is modified in accordance with the Schedule in its application to an ACT officer becoming an employee by or under a law of the Territory of a body corporate controlled by the Territory.

Repeal

 4. These Regulations cease to have effect on 1 July 1998.

 SCHEDULE Regulation 3

modification—act officer becoming employee of a body corporate controlled by the territory

1.   Section 3 (Definitions)

1.1  Subsection 3 (1) (definition of “ACT officer”):

Omit the definition, substitute:

‘ACT officer’ means a person who:

 (a) immediately before becoming a person described in paragraph (b)—is an officer within the meaning of the Public Sector Management Act 1994 of the Australian Capital Territory; and

 (b) becomes an employee of a body corporate controlled by the Territory and listed in Schedule 4 on the date specified in that Schedule for that body corporate.”.

2.   Section 6 (Mobility—appointment to Australian Public Service)

2.1   Paragraph 6 (7) (c):

Omit “the Australian Capital Territory Government Service”, substitute “employment by a body corporate controlled by the Territory and listed in Schedule 4”.

2.2   Paragraph 6 (7) (d):

Omit “a member of the Australian Capital Territory Government Service”, substitute “employed by a body corporate controlled by the Territory and listed in Schedule 4”.

3.   Section 8 (Transfer of personnel files)

3.1   Subsection 8 (3):

After “Government Service”, insert “or a body corporate, listed in Schedule 4, that became the employer of the person”.

4.   New Schedule 4

4.1  Add at the end:
