Australian War Memorial Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Australian War Memorial Act 1980.

1. Commencement

1.1 These Regulations commence on 1 January 1991.

2. Amendment

2.1 The Australian War Memorial Regulations are amended as set out in these Regulations.

3. Regulation 3 (Interpretation)

3.1 Insert the following definitions:

"'entry charge' means a charge fixed under subregulation 8A (1);

'exhibition areas' means the areas of the Memorial building that:

(a) are open to the public; and

(b) contain exhibitions and displays of historical material from the memorial collection or historical material that is otherwise in the possession of the Memorial;

'opening hours' means the hours determined by the Council from time to time as the hours during which the exhibition areas are to be open

to the public;".

4. New regulation 8a

4.1 After regulation 8, insert:

Entry charge

"8A. (1) Subject to subregulations (4), (5), (6) and (7), the entry charge fixed for entry into the exhibition areas during opening hours is, for any day other than Anzac Day or Remembrance Day:

(a) for entry by a person (other than a prescribed person)—$3.00; and

(b) for entry by a prescribed person referred to in paragraph (2) (c), (d) or (e)—$2.00.

"(2) For the purposes of subregulation (1), each of the following is a prescribed person:

(a) a child under the age of 15 years;

(b) a full-time student at a school, college or university who is under the age of 25 years;

(c) a person who is in receipt of a pension or benefit payable under Part IV, V, VI, XIII or XVI of the Social Security Act 1947;

(d) a person who is in receipt of pension under Part II or Part III of the Veterans' Entitlements Act 1986;

(e) a member, or former member, of the Defence Force, who served overseas on active service or on operational service or who, during the Second World War, served on active service in Australia (including a member of the Defence Force who is regarded as having rendered operational service within the meaning of in paragraph 6(1) (b), (c) or (d) of the Veterans' Entitlements Act 1986).

"(3) The Memorial may issue an annual season pass to any member of the public for a fee of $10.00.

"(4) The holder of an annual season pass is entitled to unlimited free visits to the exhibition areas during opening hours for a period of 12 months commencing on the date of issue of the pass.

"(5) If a person is the holder of a ticket issued by the Memorial that entitles the holder to attend:

(a) a lecture; or

(b) an educational presentation; or

(c) a cultural presentation;

on a day in the exhibition areas, an entry charge is not payable by that person for that day.

"(6) A person who has been admitted to the exhibition areas during opening hours on a day may:

(a) on leaving the exhibition areas, obtain a pass issued by authority

of the Council for the purposes of this subregulation; and

(b) on surrender of that pass, be re-admitted without further payment during opening hours within 24 hours of the pass being issued.

"(7) This regulation does not apply to entry to the exhibition areas by a person:

(a) at the invitation of the Memorial; or

(b) for purposes connected with the operation of the Memorial, the maintenance of memorial material or the maintenance, renovation, reconstruction or extension of the Memorial building; or

(c) for the provision of services to the Memorial; or

(d) on Anzac Day or Remembrance Day.".
