Fishing Levy (Northern Shark Fishery) Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Fishing Levy 1991 and the Fisheries Management Act 1991.

Citation

 1. These Regulations may be cited as the Fishing Levy (Northern Shark Fishery) Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901,  s. 48.]

Interpretation

 2. In these Regulations, unless the contrary intention appears:

“fishing permit” means a fishing permit for fishing in one or more of the zones of the Northern Shark Fishery, except:

 (a) a fishing permit within the meaning of the Fishing Levy (North West Slope Trawl Fishery) Regulations; or

 (b) a fishing permit within the meaning of the Fishing Levy (Northern Fish Trawl Fishery) Regulations;

“Gulf of Carpenteria Zone” means the part of the Northern Shark Fishery specified in Part 1 of the Schedule;

“Levy Act” means the Fishing Levy Act 1991;

“Management Act” means the Fisheries Management Act 1991;

“Northern Shark Fishery” means that part of the Australian fishing zone that comprises the Gulf of Carpentaria Zone, the Northern Territory Zone and the Western Australian Zone;

“Northern Territory Zone” means the part of the Northern Shark Fishery specified in Part 2 of the Schedule;

“Western Australian Zone” means the part of the Northern Shark Fishery specified in Part 3 of the Schedule;

“zone” means the Gulf of Carpentaria Zone, the Northern Territory Zone or the Western Australian Zone.

Amount of levy

 3. For the purposes of section 6 of the Levy Act, the amount of levy prescribed for a fishing permit in respect of a zone is $1,371.

When levy is due and payable

 4. For the purposes of section 110 of the Management Act, levy is due and payable:

 (a) if the fishing permit was granted before the commencement of these Regulations—on or before 30 November 1993; and

 (b) if the fishing permit was granted after that commencement—on the grant of the permit.

 SCHEDULE Regulation 2

 

NORTHERN SHARK FISHERY

PART 1—GULF OF CARPENTARIA ZONE

 

The area bounded by a line:

 (a) beginning at the intersection of the outer limit of the Australian fishing zone by the meridian of longitude 136°40 east; and

 (b) running:

 (i) from there southerly along that meridian to its intersection by the northern coastline of Australia at mean low water; and

 (ii) from there generally south-westerly, south-easterly and northerly along that coastline at mean low water to its intersection by the parallel of latitude 11°05 06 ; and

 (iii) from there westerly along that parallel to its intersection by the baseline constituting the inner limit of the territorial sea of Australia off the western coastline of Cape York Peninsula; and

 (iv) from there generally north-westerly and north-easterly along that inner limit to its intersection by the parallel of latitude 10°28 south; and

 (v) from there westerly along the parallel of latitude 10°28 south to its intersection by the meridian of longitude 141°20 east; and

 (vi) from there northerly along the meridian to its intersection by the outer limit of the Australian fishing zone; and

 (vii) from there generally south-westerly and north-westerly along that outer limit to the point where the line began.

PART 2—NORTHERN TERRITORY ZONE

 

The area bounded by a line:

 (a) beginning at the intersection of the northern coastline of Australia at mean low water by the meridian of longitude 129°00 east; and

 (b) running:

 (i) from there northerly along the geodesic to the point of latitude 14°37 30 south, longitude 129°01 45 east; and

 (ii) from there northerly along the geodesic to the point of latitude 14°32 30 south, longitude 129°01 15 east; and

 (iii) from there north-westerly along the geodesic to the point of latitude 14°19 30 south, longitude 128°53 east; and

 (iv) from there north-westerly along the geodesic to the point of latitude 14°00 south, longitude 128°42 15 east; and

 (v) from there north-westerly along the geodesic to the point of latitude 13°49 45 south, longitude 128°33 15 east; and

 (vi) from there north-westerly along the geodesic  to the point of latitude 13°39 45 south, longitude 128°30 45 east; and

 (vii) from there north-westerly along the geodesic  to the point of latitude 13°15 30 south, longitude 128°28 east; and

 (viii) from there northerly along the meridian of longitude 128°28 east to its intersection by the parallel of latitude 12°55 30 south; and

 (ix) from there north-westerly along the geodesic  to the point of latitude 12°32 45 south, longitude 128°24 east; and

 (x) from there north-westerly along the geodesic  to the point of latitude 12°26 30 south, longitude 128°22 east; and

 (xi) from there north-westerly along the geodesic  to the point of latitude 11°48 south, longitude 127°53 45 east; and

 (xii) from there north-westerly along the geodesic to the point of latitude 11°13 32 south, longitude 127°32 11 east; and

 (xiii) from there north-easterly along the geodesic to the point on the outer limit of the Australian fishing zone at latitude 10°55 south, longitude 127°47 east; and

 (xiv) from there generally easterly along that outer limit to its intersection by the meridian of longitude 136°40 east; and

 (xv) from there southerly along the meridian to its intersection by the northern coastline of Australia at mean low water; and

 (xvi) from there generally westerly and south-westerly along that coastline at mean low water to the point where the line began.

PART 3—WESTERN AUSTRALIA ZONE

 

The area bounded by a line:

 (a) beginning at the intersection of the northern coastline of Australia at mean low water by the meridian of longitude 129°00 east; and

 (b) running:

 (i) from there northerly along the geodesic to the point of latitude 14°37 30 south, longitude 129°01 45 east; and

 (ii) from there northerly along the geodesic to the point of latitude 14°32 30 south, longitude 129°01 15 east; and

 (iii) from there north-westerly along the geodesic to the point of latitude 14°19 30 south, longitude 128°53 east; and

 (iv) from there north-westerly along the geodesic to the point of latitude 14°00 south, longitude 128°42 15 east; and

 (v) from there north-westerly along the geodesic to the point of latitude 13°49 45 south, longitude 128°33 15 east; and

 (xiii) from there south-westerly along the geodesic to the point of latitude 11°15 south, longitude 127°31 east; and

 (xix) from there generally north-easterly along that coastline at mean low water to the point where the line began.
