An Act to deal with consequential matters in connection with the Water Act 2007, and for related purposes

The Parliament of Australia enacts:

1  Short title

  This Act may be cited as the Water (Consequential Amendments) Act 2007.

2  Commencement

 (1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

The day on which this Act receives the Royal Assent.

2.  Schedule 1

At the same time as section 3 of the Water Act 2007 commences.

Note: This table relates only to the provisions of this Act as originally passed by both Houses of the Parliament and assented to. It will not be expanded to deal with provisions inserted in this Act after assent.

  Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.


Schedule 1Amendments

 

Meteorology Act 1955

1  At the end of paragraphs 6(1)(a) to (g)

Add “and”.

2  At the end of subsection 6(1)

Add:

 ; and (j) such other functions as are conferred on the Bureau by any other Act.

3  Subsection 7(1)

Omit “the last preceding section”, substitute “section 6 (including any of its functions under Part 7 of the Water Act 2007)”.

4  Section 8

Omit “in pursuance of this Act”, substitute “pursuant to this Act or Part 7 of the Water Act 2007”.

National Water Commission Act 2004

5  Paragraph 7(1)(f)

After “function”, insert “conferred by another law of the Commonwealth or”.

Trade Practices Act 1974

6  Subsection 25(1)

After “Telecommunications (Consumer Protection and Service Standards) Act 1999,”, insert “the Water Act 2007,”.

7  Subsection 155(1)

After “(as defined by subsection (9))”, insert “or a designated water matter (as defined by subsection (9A))”.

8  After subsection 155(9)

Insert:

 (9A) A reference in this section to a designated water matter is a reference to the performance of a function, or the exercise of a power, conferred on the Commission by or under:

 (a) Part 4 of the Water Act 2007; or

 (b) regulations made under that Act for the purposes of that Part; or

 (c) water charge rules, or water market rules, made under that Part.
