An Act to deal with consequential matters in connection with the Dental Benefits Act 2008, and for other purposes

The Parliament of Australia enacts:

1  Short title

  This Act may be cited as the Dental Benefits (Consequential Amendments) Act 2008.

2  Commencement

 (1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Insert:

2  After paragraph 162(1)(a)

Insert:

 (aa) the Dental Benefits Act 2008; or

3  After paragraph 162(2)(d)

Insert:

 (daa) for the purposes of the Dental Benefits Act 2008; or

Health Insurance Act 1973

4  Subsection 130(1)

After “1973”, insert “, the Dental Benefits Act 2008”.

Jurisdiction of Courts (Crossvesting) Act 1987

5  Schedule

Insert in its appropriate alphabetical position, determined on a letterbyletter basis:

6  Section 3

Insert:

dental benefit has the same meaning as in the Dental Benefits Act 2008.

7  After paragraph 3A(1)(bb)

Insert:

 (bc) an offence against the Dental Benefits Act 2008; or

8  Paragraph 3A(1)(c)

Omit “or (bb)”, substitute “, (bb) or (bc)”.

9  After paragraph 3A(2)(ba)

Insert:

 (bb) an offence against section 50, 51, 52, 53 or 54 of the Dental Benefits Act 2008; or

10  Paragraph 3A(2)(c)

Omit “or (ba)”, substitute “, (ba) or (bb)”.

11  Subparagraph 3A(2)(d)(i)

After “service”, insert “or dental service”.

12  After paragraph 3A(2A)(ca)

Insert:

 (cb) an offence against section 50, 51, 52, 53 or 54 of the Dental Benefits Act 2008; or

13  Paragraph 3A(2A)(d)

Omit “or (ca)”, substitute “, (ca) or (cb)”.

14  Subparagraph 3A(2A)(e)(i)

After “service”, insert “or dental service”.

15  Subsection 3A(3)

Insert:

dental service has the same meaning as in the Dental Benefits Act 2008.

16  Paragraph 8P(4)(b)

Repeal the paragraph, substitute:

 (b) the information or documents relate to:

 (i) a service the person has received in respect of which medicare benefit or dental benefit has been claimed; or

 (ii) a pharmaceutical benefit supplied to, or in respect of, the person.

17  Subsection 8U(5)

Omit all the words after “that are”, substitute:

  associated with:

 (a) rendering services in respect of which medicare benefits or dental benefits have been paid or may be payable; or

 (b) the prescription for the supply of, or the supply of, pharmaceutical benefits.

Sea Installations Act 1987

18  Schedule

Insert in its appropriate alphabetical position, determined on a letterbyletter basis:

19  Subsection 202(1)

Omit all the words after “security law”, substitute “, the Farm Household Support Act 1992, the Dental Benefits Act 2008 or the Family Homelessness Prevention and Early Intervention Pilot”.

Omit “or the Farm Household Support Act 1992”, substitute “, the Farm Household Support Act 1992 or the Dental Benefits Act 2008”.

Student Assistance Act 1973

21  At the end of subsection 351(1)

Add “or the Dental Benefits Act 2008”.

22  After paragraph 351(2)(d)

Insert:
