NOTICE OF PROPOSED AMENDMENTS  -  RADIOCOMMUNICATIONS  LICENCE CONDITIONS (AMATEUR LICENCE) DETERMINATION NO. 1 OF 1997 AND RADIOCOMMUNICATION (OVERSEAS AMATEURS VISITING AUSTRALIA) CLASS LICENCE 2008

Under section 136 of the Radiocommunications Act 1992  the Australian Communications and Media Authority (the ACMA) hereby gives written notice of the following proposed amendments to:

  1. the Radiocommunications Licence Conditions (Amateur Licence) Determination No. 1 of 1997 (the LCD); and
  2. the Radiocommunications (Overseas Amateurs Visiting Australia) Class Licence 2008 (the Class Licence).

The Australian Communications and Media Authority (the ACMA) is proposing amendments to the LCD and the Class Licence that will remove the existing authorisation for amateurs to operate stations in the frequency range 420 to 430 MHz and authorise amateurs to operate stations in the frequency range 472 to 479 kHz.

The reason for the removal of amateurs’ use in the 420 to 430 MHz range is to allow for greater harmonisation in the 400 MHz band as a consequence of the ACMA’s review of the band reported in the ACMA’s paper ‘The Way ahead – Decisions and implementation options for the 400 MHz band dated December 2010.

The reason for the addition of the frequency range 472 to 479 kHz to the LCD and the Class Licence is to provide authorisation for amateurs to operate in that frequency range. This will align Australia’s regulation with the agreed outcomes of the World Radiocommunication Conference 2012 (WRC-12). Australia implements outcomes of the WRC-12 in a treaty that is ratified by the Australian Government. The relevant legislative instruments should also reflect these agreed outcomes.
