An Act to amend the Australian Immunisation Register Act 2015 and to deal with consequential and transitional matters arising from the enactment and amendment of that Act, and for related purposes

[Assented to 12 November 2015]

The Parliament of Australia enacts:

1  Short title

  This Act may be cited as the Australian Immunisation Register (Consequential and Transitional Provisions) Act 2015.

2  Commencement

 (1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

(a) a single day to be fixed by Proclamation; and

(b) the day after the end of the period of 12 months beginning on the day this Act receives the Royal Assent.

However, if the Australian Immunisation Register Act 2015 does not commence, the provisions do not commence at all.

 (2) Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.

  Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments commencing 1 January 2016

 

A New Tax System (Family Assistance) Act 1999

1  Subsection 3(1) (definition of recognised immunisation provider)

Repeal the definition, substitute:

recognised immunisation provider has the same meaning as recognised vaccination provider in the Australian Immunisation Register Act 2015.

Child Support (Registration and Collection) Act 1988

2  Subsection 16AB(3) (after paragraph (c) of the definition of designated program Act)

Insert:

 (ca) the Australian Immunisation Register Act 2015; or

Freedom of Information Act 1982

3  Schedule 3

Insert in its appropriate alphabetical position, determined on a letterbyletter basis:

4  Section 5 (definition of Australian Childhood Immunisation Register)

Repeal the definition, substitute:

Australian Childhood Immunisation Register means the Australian Childhood Immunisation Register kept under Part 2 of the Australian Immunisation Register Act 2015.

5  Part IVA

Repeal the Part.

6  Subsections 130(3B), (3C), (3D), (3E), (3F) and (3G)

Repeal the subsections.

7  After subsection 130(5F)

Insert:

 (5G) This section does not prohibit a person from providing information for inclusion in the register kept under Part 2 of the Australian Immunisation Register Act 2015.

Repeal the section, substitute:

This Act establishes a register of information about vaccinations.

The purposes of the register relate to supporting Australian vaccination programs, and vaccination matters more broadly.

Sensitive information in the register is protected.

2  Section 4 (definition of ACI register)

Repeal the definition.

Insert:

AI register means the Australian Immunisation Register.

legal personal representative, of an individual, means:

 (a) a parent or guardian of the individual, if the individual is under the age of 18 years; or

 (b) a trustee of an estate of the individual, if the individual is under a legal disability; or

 (c) a person who holds an enduring power of attorney granted by the individual.

4  Section 4 (definition of purposes of the ACI register)

Repeal the definition.

Insert:

purposes of the AI register means the purposes set out in section 10.

7  Simplified outline of this Part

The Australian Immunisation Register is established to keep information about vaccinations of individuals.

The purposes of the register relate to supporting Australian vaccination programs, and vaccination matters more broadly.

Individuals can opt out from receiving certain information from the register. They can also request for their information in the register not to be disclosed for certain purposes.

Payments relating to vaccinations may be made on behalf of the Commonwealth.
