Subregulations 12.23(3) and 12.23A(3)

 

BOODEREE NATIONAL PARK

 

PROHIBITION AND REVOCATION OF ACCESS TO CERTAIN AREAS

AND UNDERTAKING OF CERTAIN ACTIVITIES WITHIN THE PARK (No.2)

 

 

I, Dr James Findlay. Director of National Parks, acting pursuant to subregulations 12.23(3) and 12.23A(3) of the Environment Protection and Biodiversity Conservation Regulations 2000 (Regulations), having taken into account and being satisfied that access to certain areas and undertaking of certain activities in the Booderee National Park (Park) might endanger public safety, HEREBY·PROHIBIT:

 

1. the entry to areas in the Park specified in the schedule to this prohibition (Schedule); and

 

2. the undertaking of activities in the Park specified in the Schedule,

 

by the persons and during the times specified in the Schedule;

 

AND I HEREBY REVOKE, under subregulations 12.23(3) and 12.23A(3) of the Regulations, the prohibition I made in relation to access to certain areas and the undertaking of certain activities in the Park, dated 24 March 2020.

SCHEDULE

 

 

Prohibited areas

 

All areas that comprise the Park.

 

Prohibited activities

 

Entering the Park, and being in the Park.

 

Prohibited persons

 

All persons excepting:

 

1. residents of the Jervis Bay Territory;

 

2. invited visitors of residents of the Jervis Bay Territory; and

 

3. minimum services personnel in the performance of their duties.

 

Note 1: Certain other classes of person will be exempt from this prohibition by operation of

subregulations 12.06(1), 12.23(2) and 12.23A(2) of the Regulations.

 

Note 2: For the purposes of this prohibition 'minimum services personnel' means healthcare workers, persons involved in the delivery or sale of food and essential personal items, persons involved in the delivery and maintenance of utilities including water, sewer, electricity and gas, persons involved in the provision of government services, banking, telecommunications, transport, hygiene, animal health, fuel, postal and refuse collection, and emergency services personnel including police, fire and ambulance.

 

Prohibited times

 

At all times that this prohibition is in effect, and for that purpose this prohibition commences on the date and at the time on which this prohibition takes effect pursuant to law, and ends at 11.59pm AEST on 30th April 2020.
