Victorian Heavy Vehicle Standards (Agricultural Vehicles and Special Purpose Vehicles) Exemption Notice 2024 (No.1)

 

  1.       Purpose

The purpose of this notice is to exempt agricultural vehicles and special purpose vehicles that are heavy vehicles from compliance with the Heavy Vehicle (Vehicle Standards) National Regulation (the National Regulation).

  1.       Authorising Provision

This notice is made under section 61 of the Heavy Vehicle National Law (HVNL) as in force in Victoria.

  1.       Commencement

This notice commences on 2 September 2024.

  1.       Expiry

This notice expires on 1 September 2029.

  1.       Definitions
  1.     Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL.
  2.     In this notice—

Agricultural vehicle means an agricultural implement or agricultural machine.

Certificate of Approved Operations means a certificate of that name issued pursuant to the Road Safety (Vehicles) Regulations (Vic) as amended or remade from time-to-time.

Conditional registration means registration granted to a vehicle that does not comply with the vehicle standards, that is either affixed with an operations plate or has been issued with a certificate of approved operations, pursuant to the Road Safety (Vehicles) Regulations (Vic) as amended or remade from time-to-time.

Operations plate means a plate of that name issued pursuant to section 21 of the Road Safety (Vehicles) Regulations 2009 (Vic) as amended or remade from time-to-time.


Special purpose vehicle means—

(a) a vehicle (other than a caravan, a mobile home, a mobile library, a mobile workshop, a mobile laboratory or a mobile billboard) built, or permanently modified, for a primary purpose other than the carriage of goods or passengers; or

(b) any of the following vehicles—

(i) a forklift;

(ii) a straddle carrier;

(iii) a mobile cherry picker;

(iv) a mobile crane.

This notice may be cited as the Victorian Heavy Vehicle Standards (Agricultural Vehicles and Special Purpose Vehicles) Exemption Notice 2024 (No.1).

  1.       Exemption from Prescribed Vehicle Standards

An eligible vehicle is exempted from the standards in Schedule 2 of the National Regulation listed in Table 1.
