Sydney Airport Curfew Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, make the following Regulations under the Sydney Airport Curfew Act 1995.

Citation

 1. These Regulations may be cited as the Sydney Airport Curfew Regulations.

 

Commencement

 2. These Regulations commence on the day on which the Sydney Airport Curfew Act 1995 commences.

Interpretation

 3. In these Regulations:

“Act” means the Sydney Airport Curfew Act 1995.

Meaning of “air traffic controller”

 4. For the purposes of the definition of “air traffic controller” in section 3 of the Act, “air traffic controller” means an employee of Airservices Australia who is authorised under subregulation 102 (1) of the Civil Aviation Regulations to act in an air traffic control capacity.

Address for lodgment of return

 5. (1) For the purposes of paragraphs 8 (3) (d) and 9 (3) (e) of the Act, the prescribed address for lodgment of a return by post is:

 (2) For the purposes of paragraphs 8 (3) (d) and 9 (3) (e) of the Act, the prescribed address for lodgment of a return in person is:

 

  Airservices Australia

  Alan Woods Building

  25 Constitution Avenue

  CANBERRA CITY 2601.

[NOTE:   Under subsection 8 (3) of the Act, the return must be given to an authorised person.   “Authorised person” is defined in section 3 of the Act.]

Prescribed number—subsection 12 (8) of the Act

 6. (1) For the purposes of paragraph 12 (8) (a) of the Act, the prescribed number of take-offs and landings is 0.

 (2) For the purposes of paragraph 12 (8) (b) of the Act, the prescribed number of take-offs and landings is 0.

Prescribed number—subsection 12 (9) of the Act

 7. (1) For the purposes of paragraph 12 (9) (a) of the Act, the prescribed number of landings is 24.

 (2) For the purposes of paragraph 12 (9) (b) of the Act, the prescribed number of landings is 5.

Specified persons—subsection 13 (1) of the Act

 8. For the purposes of subsection 13 (1) of the Act, each of the following persons is a specified person:

 (a) Ansett Australia Limited;

 (b) National Jet Systems Proprietary Limited;

 (c) Mayne Nickless Limited.

Specified persons—subsection 13 (2) of the Act

 9. For the purposes of subsection 13 (2) of the Act, Mayne Nickless Limited is a specified person.

Prescribed number—subsection 13 (3) of the Act

 10. For the purposes of subsection 13 (3) of the Act, the prescribed number of take-offs and landings is:

 (a) for aircraft registered in the name of, or operated by or on behalf of Ansett Australia Limited—28; and

 (b) for aircraft registered in the name of, or operated by or on behalf of National Jet Systems Proprietary Limited—28; and


 (c) for aircraft registered in the name of, or operated by or on behalf of Mayne Nickless Limited:

 (i) if the week ends on or before 5 May 1996—9; and

 (ii) if the week ends after 5 May 1996—18.
