Diplomatic Privileges and Immunities Regulations 2 (Amendment)

 

 

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Diplomatic Privileges and Immunities Act 1967.

1.   Amendment

1.1   The Diplomatic Privileges and Immunities Regulations are amended as set out in these Regulations.

 

[NOTE:  These Regulations commence on gazettal:  see Acts Interpretation Act 1901, s.48]


2.   Regulation 2 (Interpretation)

2.1   Before the definition of “Commission of the European Communities”, insert:

‘certificate’ means certificate referred to in subregulation 5a (1);”.

 

 

3.   Regulation 5a (Minister may issue certificates in certain circumstances)

3.1   Subregulation 5a (1):

Omit “in his or her opinion”.

 

3.2   Subregulation 5a (1):

Omit “within the meaning of”, substitute “to give effect to”.

 

3.3   Subregulation 5a (2):

Add at the end:

 “; (d) whether a measure other than removal of the object would give effect to the special duty of Australia under Article 22 of the Convention”.

 

 

4.   Regulation 5b (Removal of prescribed objects from prescribed land or premises)

4.1   Paragraph 5b (3) (d):

Omit the paragraph, substitute:

 “(d) that is not on prescribed land or premises described in the certificate”.

 

 

5.   Schedule

5.1   Omit “in my opinion”.

 

5.2   Omit “within the meaning of”, substitute “to give effect to”.
