Federal Proceedings (Costs) Regulations

 

 

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Federal Proceedings (Costs) Act 1981.

Citation

 1. These Regulations may be cited as the Federal Proceedings (Costs) Regulations.


Commencement

 2. These Regulations commence on 1 September 1991.

 

 

Interpretation

 3. In these Regulations, unless the contrary intention appears:

“the Act” means the Federal Proceedings (Costs) Act 1981.

 

 

Prescribed maximum amounts: appeals or new trials

 4. For the purposes of subsection 18 (1) of the Act (limits of payments in respect of appeals or other proceedings), the amount specified in an item in column 2 of the following table is the prescribed maximum amount in respect of the court specified in column 1 of the item:

Application of regulation 4

 5. Regulation 4 applies in relation to a costs certificate granted as a result of an appeal decided on or after the commencement of these Regulations.
