Air Navigation (Aircraft Noise) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Navigation Act 1920.

Principal Regulations

1. In these Regulations, Principal Regulations means the Air Navigation (Aircraft Noise) Regulations.

Interpretation

2. Regulation 2 of the Principal Regulations is amended by inserting after the definition of operator the following definition:

“ ‘relevant law means a law of a contracting State relating to the control of aircraft noise, being a law—

(a) the requirements of which are incapable of being complied with by an aircraft that does not satisfy the requirements of the Annex with respect to noise certification; or

(b) compliance with the requirements of which has been determined by the Secretary or an authorized officer, by notice published in the Gazette, to be sufficient compliance with the requirements of the Annex with respect to noise certification;.

Noise certificate deemed to be issued in certain circumstances

3. Regulation 8 of the Principal Regulations is amended by omitting sub-regulation (3).

Revocation of noise certificates

4. Regulation 10 of the Principal Regulations is amended—

(a) by inserting or with the requirements of the relevant law, whichever were relevant to noise certification in respect of that aircraft, after aircraft belongs in sub-regulation (1); and

(b) by inserting or with the requirements of the relevant law, whichever were relevant to noise certification in respect of that aircraft,after aircraft belongs in paragraph (2) (a).

Inspectors

5. Regulation 11 of the Principal Regulations is amended by inserting or with the requirements of the relevant law, whichever were relevant to noise certification in respect of that aircraft after aircraft belongs in sub-regulation (3).
