Superannuation (Eligible Employees) Regulations2 (Amendment)
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Superannuation Act 1976.

Certain employees not to be eligible employees
1. Regulation 4 of the Superannuation (Eligible Employees) Regulations is amended—
(a) by inserting after paragraph (a) the following paragraph:
“(aa) persons (including persons specified in a direction given under section 14 of the Act) who—
(i) are the holders of a statutory office; and
(ii) are members of a superannuation or retirement scheme applying to holders of that office (not being the scheme constituted by the provisions of the Act) or are required by the terms or conditions of their appointment to become (subject to compliance with, or fulfilment of, any conditions or requirements relating to membership of the scheme) such members;”; and
(b) by adding at the end thereof the following paragraphs:
“(m) persons who—
(i) immediately before 1 October 1982 were Commissioners, officers or employees of the Australian Shipping Commission and have continued to be, and are, so appointed or employed; and
(ii) were not, immediately before that date, eligible employees;
(n) persons who—
(i) are Commissioners, officers or employees of the Australian Shipping Commission, other than persons who were, immediately before 1 October 1982, so appointed or employed and have, on and after that date, continued to be so appointed or employed; and
(ii) were not, immediately before being appointed or employed as Commissioners, officers or employees of the Australian Shipping Commission, eligible employees or invalidity pensioners.”.
Commencement
2. Regulation 1 shall come into operation on 1 October 1982.
