Maternity Leave (Commonwealth Employees) Regulations
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Maternity Leave (Commonwealth Employees) Act 1973.

Citation
1. These Regulations may be cited as the Maternity Leave (Commonwealth Employees) Regulations.
Repeal of Maternity Leave (Australian Government Employees) Regulations
2. Statutory Rules 1974 No. 82 and Statutory Rules 1978 No. 107 are repealed.
Interpretation
3. In these Regulations, “the Act” means the Maternity Leave (Commonwealth Employees Act 1973.
Prescribed authorities
4. For the purposes of the definition of “prescribed authority” in section 3 of the Act—
(a) a body corporate specified in column 2 of Schedule 1 in an item in that Schedule is declared to be a body corporate; and
(b) an unincorporated body specified in column 2 of Schedule 2 in and item in that Schedule is declared to be an unincorporated body,
in relation to which the Act applies.
Unauthorized absence
5. For the purposes of sub-section 3 (2) of the Act, and absence from duty by an employee, being an absence in respect of which leave has not been granted in pursuance of a law of the Commonwealth or of a Territory (other than the Northern Territory), or any instrument made or issued under such a law, that provides for terms and conditions of employment that are applicable to that employee is an unauthorized absence in relation to that employee.
Prescribed person
6. For the purposes of paragraph 5 (1) (b) of the Act—
(a) a person who constitutes, or is a member of, or a person employed by, a body corporate or an unincorporated body referred to in regulation 4; or
(b) a person specified in column 2 of Schedule 3 in an item in that Schedule,
is a prescribed person.
