Commission for the Conservation of Antarctic Marine Living Resources (Privileges and Immunities) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the International Organisations (Privileges and Immunities) Act 1963.

1.   Amendment

1.1   The Commission for the Conservation of Antarctic Marine Living Resources (Privileges and Immunities) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s 48.]

2.   Regulation 2 (Interpretation)

2.1   Insert the following definition:

‘serious offence’ means an offence under any law of the Commonwealth or a State or a Territory for which, if the offence had taken place in the Jervis Bay Territory, a person would be liable, on first conviction, to imprisonment for a period of not less than 5 years;”.

3.   Regulation 5 (Privileges and immunities of Commission)

3.1   Omit “8 and 9,”, substitute “8, 9 and 9AA,”.

4.   New regulation 9AA

4.1   After regulation 9, insert:

Exemption from sales tax

 9AA. (1) The transactions of the Commission are not exempt from sales tax except as mentioned in subregulation (2).

 (2) Sales tax is not payable in respect of goods purchased by the Commission if the goods:

 (a) are for the official use of the Commission (including official entertainment by the Commission); and

 (b) are reasonably necessary for conduct of the Commission’s business.”.

5.   Regulation 10A (Privileges and immunities of representatives attending conferences convened by Commission)

5.1   Subregulation 10A (5):

Omit the subregulation.

6.   Regulation 10B (Privileges and immunities of experts working with the Commission)

6.1   Subregulation 10B (6):

Omit the subregulation.

7.   Regulation 11 (Waiver of privileges and immunities)

7.1   Paragraph 11 (4) (d):

Omit “paragraph (a);”, substitute “paragraph (c);”.

8.   Further amendments—spelling of “organisation”

8.1   The Regulations are further amended as set out in the following table:
