Product Stewardship (Oil) Regulations 2000

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Product Stewardship (Oil) Act 2000.

Schedule 1 Re-refined base oil criteria
These Regulations are the Product Stewardship (Oil) Regulations 2000.
These Regulations commence on the commencement of
section 10 of the Act.
In these Regulations:
Act means the Product Stewardship (Oil) Act 2000.
EPA means the Environmental Protection Agency of the United States of America.
4 Amount of product stewardship benefit
(1) For subsection 10 (1) of the Act, the amount of product stewardship (oil) benefit for a claim period is the amount mentioned for the first category in the following table that applies to the recycled oil.

Examples for item 2
Chain bar oil, oil incorporated into a manufactured product.
(2) However, no product stewardship benefit is payable in respect of oil that is to undergo further recycling before it is sold to the end user.
(3) For item 1 of the table to subregulation (1):
(a) the criteria must be verified by a laboratory accredited, by the national laboratory accreditation body operating in the country where the laboratory is located, to perform the tests mentioned in the criteria; and
(b) the verification must be given to the Commissioner:
(i) with the first claim for benefit; and
(ii) at intervals of not more than 6 months while the benefit is being claimed.
(4) For paragraph (3) (a), a national accreditation body must:
(a) be a member of the International Laboratory Accreditation Corporation; and
(b) accept the accreditation standards of that Corporation.
Schedule 1 Re-refined base oil criteria

1 Mutagenicity
The oil must be non-carcinogenic, demonstrated by having a mutagenicity index of less than 1 and an x-fold increase of less than 2, under the criteria mentioned in the Modified Ames Test (American Society for Testing and Materials test number E1687-98).
Note The purpose of this criterion is the protection of users of the oil and workers from carcinogenic compounds.
2 Poly-aromatic hydrocarbons
The oil must contain less than 1 000 mg of poly-aromatic hydrocarbons for each kilogram of oil, demonstrated by meeting the criteria mentioned in EPA test SWA-846 8275A.
Note The purpose of this criterion is the protection of users of the oil and workers from carcinogenic compounds.
3 Polychlorinated biphenyls
The oil must contain less than 0.1 mg of polychlorinated biphenyls for each kilogram of oil, demonstrated by meeting the criteria mentioned in EPA test SWA-846 8082.
Note This criterion is included because these compounds are highly carcinogenic.
4 Polychlorinated dibenzo-p-dioxins
The oil must not contain polychlorinated dibenzo-p-dioxins, demonstrated by meeting the criteria mentioned in EPA test SWA-846 8290.
Note This criterion is included because these compounds are highly carcinogenic.
5 Total acid number
The oil must have a total acid number of less than 0.03 mg of potassium hydroxide for each gram of oil, demonstrated by meeting the criteria mentioned in American Society for Testing and Materials test number D974-97.
Note This criterion is included because stability of an oil is critical to meeting health, safety and environment standards. The total acid number of an oil is a good measure of stability.
6 Appearance
The oil must have a clear and bright appearance.
Note This criterion is included because a base-oil that is not clear and bright is likely to contain compounds that compromise health, safety and environment standards, including carcinogenicity standards.
