Vehicle Standard (Australian Design Rule 80/00 — Emission Control for Heavy Vehicles) 2005

0.1.1 This Standard is the Vehicle Standard (Australian Design Rule 80/00 – Emission Control for Heavy Vehicles) 2005.
0.1.2 This Standard may also be cited as ADR 80/00.
0.2.1 This Standard commences on the day after it is registered.
0.3.1 This Standard repeals each vehicle standard with the name ADR 80/00, and each amendment of such a standard, that is:
(a) made under section 7 of the Motor Vehicles Standard Act 1989; and
(b) in force at the commencement of this Standard.
0.3.2 This Standard also repeals each instrument made under section 7 of the Motor Vehicles Standard Act 1989 that creates or amends a vehicle standard with the name ADR 80/00, if there are no other vehicle standards created by that instrument that are still in force at the commencement of this Standard.
1.1 This vehicle standard prescribes the exhaust emissions requirements for engines used in heavy vehicles in order to reduce air pollution.
2.1 This vehicle standard applies to vehicles of the M and N categories, with a GVM greater than 3.5 tonnes, as provided in clause 2.2.
2.2 This vehicle standard applies[1]:
2.2.1 from 1 January 2003 in relation to new model vehicles with an engine that operates on petrol produced on or after 1 January 2003;
2.2.2 from 1 January 2004 in relation to vehicles with an engine that operates on petrol, produced on or after 1 January 2004, other than new model vehicles referred to in clause 2.2.1;
2.2.3 from 1 January 2002 in relation to new model vehicles with an engine which operates on diesel, LPG or natural gas, produced on or after 1 January 2002;
2.2.4 from 1 January 2003 in relation to vehicles with an engine which operates on diesel, LPG or natural gas, produced on or after 1 January 2003, other than new model vehicles referred to in clause 2.2.3 and special omnibuses; and
2.2.5 from 1 July 2003 in relation to special omnibuses produced on or after 1 July 2003.
2.3 For the purposes of:
2.3.1 Clause 2.2.1, a "new model vehicle" is a vehicle of a model first produced with a date of manufacture on or after 1 January 2003.
2.3.2 Clause 2.2.3, a "new model vehicle" is a vehicle of a model first produced with a date of manufacture on or after 1 January 2002.
2.4 For the purposes of clauses 2.2.4 and 2.2.5, “special omnibus” means a heavy vehicle in the ME category, with an engine which operates on diesel, LPG or natural gas, that incorporates a chassis upon which an identification plate for a vehicle component has been placed in accordance with an approval under s.10A(1) of the Motor Vehicle Standards Act 1989 before 1 December 2002.
2.5 To the extent of any inconsistency, the applicability dates specified in clause 2.2 apply in lieu of any dates specified in Appendix A.
2.6 Vehicles complying with ADR 80/01 need not comply with this vehicle standard.
3.1 For the purposes of clause 2.3, “date of manufacture” means the date the vehicle is available in Australia in a condition which will enable an identification plate to be lawfully affixed to the vehicle.
4.1 Engines which operate on diesel, and which comply with the technical requirements of Appendix A, as per the limit values in row A of Table 1, and, if applicable, row A of Table 2, in section 6.2.1 of Annex I of Appendix A, will be accepted as complying with this vehicle standard.
4.2 Engines which operate on liquefied petroleum gas or natural gas, and which comply with the technical requirements of Appendix A, as per the limit values in row A of Table 2 in section 6.2.1 of Annex I of Appendix A, will be accepted as complying with this vehicle standard.
4.3 Engines which operate on petrol, and which comply with the technical requirements of the USA Code of Federal Regulations, Part 86 – Control of air pollution from new and in-use motor vehicles and new and in-use motor vehicle engines certification and test procedures - Subpart A 40 CFR 86.096-10 Emission standards for 1996 and later model year Otto-cycle heavy-duty engines and vehicles; and Sub Part N 40 CFR 86.1300 series – Emission Regulations for new Otto-cycle and diesel heavy duty engines; gaseous and particulate exhaust test procedures, will be accepted as complying with this vehicle standard.
5.1 Any provisions related to the administrative processes for obtaining an EC or US EPA approval do not apply to this vehicle standard.
5.2 The reference to “Directive 70/220/EEC, as last amended by Commission Directive 98/77/EC” in Part 1 (Scope) of Annex I to Appendix A is amended to read “ADR 79/01”.
5.3 Where ADR 79/01 is used as an alternative route for compliance with this vehicle standard, the requirements of clause 4.2 of ADR 79/01 apply, regardless of the fuel type.
6.1 For engines which operate on diesel, liquefied petroleum gas or natural gas, the technical requirements of UN ECE Regulation 49, Revision 3, Amendment 1, incorporating the 03 Series of amendments, or the technical requirements of Directive 1999/96/EC of the European Parliament and Council of 13 December 1999 amending Directive 88/77/EEC, are deemed to be equivalent to the technical requirements of this vehicle standard.
6.2. Subject to clause 6.2.1, for engines which operate on diesel, liquefied petroleum gas or natural gas, the technical requirements of the USA Code of Federal Regulations, Part 86 – Control of air pollution from new and in-use motor vehicles and new and in-use motor vehicle engines certification and test procedures - Subpart A 40 CFR 86.098-11 Emission standards for 1998 and later model year diesel heavy-duty engines and vehicles; and Subpart N 40 CFR 86.1300 series – Emission Regulations for new Otto-cycle and diesel heavy duty engines; gaseous and particulate exhaust test procedures, are deemed to be equivalent to the technical requirements of this vehicle standard.
6.2.1 The requirements of Appendix B must be met to demonstrate that any Auxiliary Emission Control Device utilised by the engine does not operate in a manner that reduces the effectiveness of the emissions control system, under conditions which may reasonably be expected to be encountered in normal vehicle operation and use, except as permitted by Appendix B.
6.3 For engines which operate on petrol, the technical requirements of the USA Code of Federal Regulations, Part 86 - Control of air pollution from new and in-use motor vehicles and new and in-use motor vehicle engines certification and test procedures - Subpart A 40 CFR 86.096-10 Emission standards for 1996 and later model year Otto-cycle heavy-duty engines and vehicles; and Subpart N 40 CFR 86.1300 series – Emission Regulations for new Otto-cycle and diesel heavy duty engines; gaseous and particulate exhaust test procedures, are deemed to be equivalent to the technical requirements of this vehicle standard.
6.4 For engines which operate on compressed natural gas, the technical requirements of the Technical Guidance (2000) to Exhaust Emissions from Compressed Natural Gas Motor Vehicles at Appendix C, issued by the Japanese Ministry of Land, Infrastructure and Transport, as applicable to motor vehicles with a gross vehicle weight exceeding 3.5 tonnes as described in row 5 of the table to clause 2(1) of the Technical Guidance, are deemed to be equivalent to the technical requirements of this vehicle standard.
