TEMPORARY ORDER

Fisheries Management Act 1991

Heard Island and McDonald Islands Fishery Management Plan 2002

I, RICHARD McLOUGHLIN, Managing Director of the Australian Fisheries Management Authority (AFMA) as delegate, being satisfied that –

(a)   it is necessary to take action under section 43 of the Fisheries Management Act 1991 as circumstances exist where urgent action is required for purposes related to the management of the Fishery;

(b)   the action contemplated is consistent with AFMA’s objectives; and

(c)   no other action is appropriate,

make the following order under section 43 of the Fisheries Management Act 1991:

That as and from the 25th day of November 2005 until the 25th day of May 2006, or until such earlier time as the Heard Island and McDonald Islands Fishery Management Plan 2002 (the Plan) is amended, Section 11 of the Plan is hereby amended by the addition of the following subsection 11(1)(A):

‘11(1)(A) Before the beginning of each fishing year, AFMA may determine the limit to the amount of any other species that may be taken from the fishery in the fishing year.’
