I, JOHN JOSEPH FAHEY, Minister for Finance and Administration, make the following Declaration under paragraph 6 (2) (c) of the Superannuation Act 1990.

This Declaration is the Superannuation (PSS) Membership Exclusion Amendment Declaration 1999 (No. 2).
This Declaration commences on the commencement of the Public Service Act 1999.
Schedule 1 amends the Superannuation (PSS) Membership Exclusion Declaration.

1 Name of Declaration
This Declaration is the Superannuation (PSS) Membership Exclusion Declaration 1995.
[2] Schedule, after item 38
insert
39 A person who:
(a) immediately before the commencement of the Public Service Act 1999, was not a PSS member; and
(b) on the commencement of the Public Service Act 1999, became an APS employee for the purposes of that Act and a permanent employee for the purposes of the Superannuation Act 1990; and
(c) has not subsequently ceased to be an APS employee for the purposes of the Public Service Act 1999; and
(d) has not requested, in writing, to be treated as a PSS member.
