1 Name of Regulations

  These Regulations are the Civil Aviation (Fees) Amendment Regulations 2007 (No. 1).

2 Commencement

  These Regulations commence as follows:

 (a) on 1 June 2007 — regulations 1 to 3 and Schedule 1;

 (b) on 1 July 2007 — regulation 4 and Schedule 2.

3 Amendment of Civil Aviation (Fees) Regulations 1995

  Schedules 1 and 2 amend the Civil Aviation (Fees) Regulations 1995.

4 Transitional

 (1) In this regulation:

new Fees Regulations means the Civil Aviation (Fees) Regulations 1995, as amended by these Regulations.

old Fees Regulations means the Civil Aviation (Fees) Regulations 1995, as in effect on 30 June 2007.

 (2) If:

 (a) a fixed fee for a service was payable under the old Fees Regulations; and

 (b) a person applied to CASA before 1 July 2007 for CASA to provide the service; and

 (c) the person paid the fee at the time of making the application;

no additional fee is payable for the service even if the service is provided on or after 1 July 2007.

 (3) If:

 (a) a fee computed at the hourly rate was payable for a service under the old Fees Regulations; and

 (b) a person applied to CASA before 1 July 2007 for CASA to provide the service; and

 (c) before 1 July 2007, CASA estimated the total cost for the service and informed the person in writing of the estimate; and

 (d) CASA did not finish providing the service before 1 July 2007;

the hourly rate payable for the service is the same as the hourly rate payable for the service under the old fees Regulations until the end of 30 September 2007.

 (4) If:

 (a) there is no fee payable for a service under the old fees Regulations but there is a fee computed at the hourly rate payable for the service under the new fees Regulations; and

 (b) a person applied to CASA before 1 July 2007 for CASA to provide the service;

a fee computed at the hourly rate is payable for that service, only to the extent that the service is provided on or after 1 July 2007.

Schedule 1 Amendment commencing on 1 June 2007

4AA Reduced fees for certain services relating to medical certificates

  Despite regulation 4, the fee payable by a person for a service specified in item 15.1, 15.2, 15.3, 15.4, 15.5 or 15.6 of Schedule 1 is $75 if, during the period commencing on 1 June 2007 and ending on 30 June 2007, the person:

 (a) undergoes a medical examination with a DAME; and

 (b) signs a medical questionnaire for the medical examination; and

 (c) lodges an application with CASA for the issue of a medical certificate under regulation 67.175 or 67.180 of CASR.

Schedule 2 Amendments commencing on 1 July 2007

(regulation 3)

[1] Subregulation 3 (1), after definition of Act

ASIC means an aviation security identification card issued under Part 6 of the Aviation Transport Security Regulations 2005.

 (1) For paragraphs 98 (3) (u) and (v) of the Act, the fee for a service specified in an item in Schedule 1, is:

 (a) the amount specified in the item; or

 (b) if the item contains ‘HR’ — for each provision of the service, the amount calculated by the formula:

 (2) In the formula in subregulation (1):

Rate is:

 (a) for:

 (i) items 2.12, 2.12A, 2.13, 2.14, 2.16, 2.17 and 15.9 of Schedule 1 — $130; and

 (ii) items 24.2, 24.5 and 24.8 of Schedule 1 — $100; or

 (b) if the interests of the safety of air navigation require that the service be provided by a senior CASA officer, or by a CASA officer with particular experience or qualifications — $190; or

 (c) in any other case — $160.

N is the total number of hours spent by CASA officers in the provision of the service.

Example   For paragraphs (b) and (c), a service in a general aviation matter is likely to be charged for at $160 per hour, and a service provided by an air transport flying operations inspector at $190 per hour.

 (6A) If a service is provided to or for a person outside Australia and, following the provision of the service, CASA:

 (a) considers that it is necessary in the interests of the safety of air navigation to inspect, assess and report on the person’s premises, operations or activities; and

 (b) requires a CASA officer or a person acting on CASA’s behalf to travel outside Australia;

the following fees are payable for the inspection, assessment and report:

 (c) a fee equal to the reasonable cost of the travel, meals, accommodation and incidental expenses of the officer or person; and

 (d) the amount calculated by the formula:

  where

  Rate is:

 (a) if the interests of the safety of air navigation require that the service be provided by a senior CASA officer, or by a CASA officer with particular experience or qualifications — $190; or

 (b) in any other case — $160.
