I, PHILIP MICHAEL JEFFERY, GovernorGeneral of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 7 of the Flags Act 1953, make these Rules in relation to the flying of the Australian Defence Force Ensign.

1 Name of Rules

  These Rules are the Flags (Australian Defence Force Ensign) Rules 2008.

2 Commencement

  These Rules are taken to have commenced on 1 October 2006.

3 Definitions

  In these Rules:

Australian Defence Force Ensign means the flag appointed to be the ensign of the Australian Defence Force under section 5 of the Flags Act 1953.

Australian White Ensign means the flag appointed under section 5 of the Flags Act 1953 to be the ensign of the Australian Navy known as the Australian White Ensign.

Royal Australian Air Force Ensign means the flag appointed to be the ensign of the Australian Air Force under section 5 of the Flags Act 1953.

4 Precedence of Australian Defence Force Ensign

  A person flying the Australian Defence Force Ensign together with the Australian White Ensign, the Royal Australian Air Force Ensign, or both of those ensigns, must fly the Australian Defence Force Ensign in a way that shows that it has precedence over each of those other ensigns.
