Amendment Statement of Principles

concerning

 

SYSTEMIC LUPUS ERYTHEMATOSUS

No. 41 of 2009

 

for the purposes of the

 

Veterans’ Entitlements Act 1986

and

Military Rehabilitation and Compensation Act 2004

 

  1.                    This Instrument may be cited as Statement of Principles concerning systemic lupus erythematosus No. 41 of 2009.

 

2.                      The Repatriation Medical Authority amends, under subsection 196B(8) of the Veterans’ Entitlements Act 1986, Statement of Principles concerning systemic lupus erythematosus No. 85 of 2007 by:

 

(A)            Replacing existing factor "(a)" in clause 6 with the following:

"(a) inhaling respirable crystalline silica dust, at the time material containing crystalline silica was being:

(i)              produced;

(ii)              excavated;

(iii)              drilled, cut or ground; or

(iv)              used in construction, manufacturing, cleaning or blasting,

for a cumulative period of at least 2000 hours before the clinical onset of systemic lupus erythematosus; or";

 

(B)             Replacing existing factor "(e)" in clause 6 with the following:

"(e) inhaling respirable crystalline silica dust, at the time material containing crystalline silica was being:

(i)              produced;

(ii)              excavated;

(iii)              drilled, cut or ground; or

(iv)              used in construction, manufacturing, cleaning or blasting,

for a cumulative period of at least 2000 hours before the clinical worsening of systemic lupus erythematosus; or";

 

(C)             Inserting a new factor "(da)" immediately following factor "(d)" in clause 6 as follows:

"(da) being exposed to sunlight or ultraviolet light at a level sufficient to induce sunburn at least 24 hours, but not more than two months, before the clinical onset of systemic lupus erythematosus; or"; and

 

(D)            Inserting a new factor "(ia)" immediately following factor "(i)" in clause 6 as follows:

"(ia) being exposed to sunlight or ultraviolet light at a level sufficient to induce sunburn at least 24 hours, but not more than two months, before the clinical worsening of systemic lupus erythematosus; or".

 

3.                      The amendments made by this instrument apply to all matters to which Instrument No. 85 of 2007, section 120A of the Veterans’ Entitlements Act 1986 and section 338 of the Military Rehabilitation and Compensation Act 2004 apply.

 

4.                      The amendment made by this instrument takes effect from 1 July 2009.
