TEMPORARY ORDER

 

Fisheries Management (Southern and Eastern Scalefish and Shark Fishery – Variation of Total Allowable Catch) Temporary Order 2009 (No.2)

 

 

 

I, GLENN HURRY, delegate of the Australian Fisheries Management Authority (AFMA), make this order under subsection 43(2) of the Fisheries Management Act 1991, being satisfied that:

 

(a)              it is necessary to take action under section 43 of the Fisheries Management Act 1991; and

 

(b)             the action is consistent with AFMA’s objectives; and

 

(c)              no other action is appropriate.

1 Name of Order
 

This Order is the Fisheries Management (Southern and Eastern Scalefish and Shark Fishery - Variation of Total Allowable Catch) Temporary Order 2009 (No.2).

 

2 Commencement and Cessation
 

This Order commences at the start of 18 December 2009 and ceases at the end of 30 April 2010.

 

3 Variation of Total Allowable Catch
 

 (a) For the fishing year that commenced on 1 May 2009 under the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003 (the Plan), the total allowable catch (TAC) determined under section 11 of the Plan for the species Deepwater flathead (Neoplatycephalus conatus), being Item 27 in Schedule 2 of the Plan, may be varied once.

 

(b) Pursuant to paragraph 3(a), the TAC for Deepwater Flathead (Neoplatycephalus conatus) that has been determined under section 11 of the Plan for the fishing year that commenced on 1 May 2009 is increased from 1,300 tonnes to 1,400 tonnes.
