Social Security (Administration) Act 1999

I, JENNY MACKLIN, Minister for Families, Housing, Community Services and Indigenous Affairs, acting under paragraph 123XPA(3)(b) of the Social Security (Administration) Act 1999 and on behalf of the Minister for Education and the Minister for Employment and Workplace Relations, make this Specification.

1               Name of Specification

This Specification is the Social Security (Administration) (Deductible portion — section 123XPA) Specification 2010.

2               Commencement

This Specification commences on 1 July 2010.

3               Revocation of previous Specification

The Social Security (Administration) (Deductible portion — section 123XPA) Specification 2009 is revoked.

4               Definitions

In this Specification:

Act means the Social Security (Administration) Act 1999.

Note 1   Baby bonus is defined in subsection 3(1) of the Family Assistance Act and has the same meaning in this Specification as in that Act.

Note 2   Category I welfare payment is defined in section 123TC of the Act and has the same meaning in this Specification as in the Act.

Note 3   Family Assistance Act is defined in subsection 23(1) of the Social Security Act 1991 and has the same meaning in this Specification as in that Act.

5               Deductible portions

For paragraph 123XPA(3)(b) of the Act:

(a) the lower percentage of 50% is specified as the deductible portion of an instalment of a category I welfare payment, other than a category I welfare payment specified in subparagraph (b)(i), (ii) or (iii); and

(b) the higher percentage of 100% is specified as the deductible portion of an instalment of the following category I welfare payments:

(i) baby bonus under the Family Assistance Act;

(ii) a payment under the scheme known as the ABSTUDY scheme that includes an amount identified as living allowance;

(iii) a payment under the scheme known as the ABSTUDY scheme that includes an amount identified as pensioner education supplement.
