1               Name of Specification

This Specification is the Social Security (Administration) (Classes of Exempt Welfare Payment Recipients) Specification 2010.

2               Commencement

This Specification commences on 9 August 2010.

3               Definitions

In this Specification:

Act means the Social Security (Administration) Act 1999.

CDEP Scheme Participant Supplement has the same meaning as in the Social Security Act.

nominated visa holder has the meaning given by subsection 23(1) of the Social Security Act.

principal carer has the meaning given by subsections 5(15) to (24) of the Social Security Act.

receiving has the same meaning as in the Social Security Act.

Social Security Act means the Social Security Act 1991.

special benefit has the same meaning as in the Social Security Act.

4               Exempt welfare payment recipients – specified classes of persons

For section 123UGB of the Act, the following classes of persons are specified to be exempt welfare payment recipients:

(a)         the class of persons each member of which:

(i)            is at least 16 years old; and

(ii)          is receiving special benefit; and

(iii)        is not a nominated visa holder; and

(iv)        is not the principal carer of a child who is aged under 6 years;

(b)         the class of persons each member of which is receiving CDEP Scheme Participant Supplement.
