NATION BUILDING PROGRAM ROADS TO RECOVERY PROGRAM CONDITIONS VARIATION 2010/1
I, ANTHONY NORMAN ALBANESE, Minister for Infrastructure and Transport, under section 90(5) of the Nation Building Program (National Land Transport) Act 2009 (the Act), vary the conditions applying to payments under Part 8 of the Act which were determined by me on 9 September 2009.

This variation instrument is the Nation Building Program Roads to Recovery Program Conditions Variation 2010/1.
2. Commencement
This variation commences on the day after registration and applies to payments made under Part 8 of the Act from the date of commencement of this variation to 30 June 2014.
3. Variation
3.1 In clause 6.2(a)(v), omit 'that Year.' and substitute 'that Year; and'.
3.2 Amend the note which follows clause 6.2(a)(v) by inserting the words ‘to clause 6.2(a)(v)’ after the word ‘Note’.
3.3 At the end of the note to clause 6.2(a)(v), insert a new clause 6.2(a)(vi) as follows:
(vi) the amount of own source expenditure on roads expended during the year to which the statement relates.
3.4 Amend the note on clause 6.2(a) by deleting the words ‘can be prepared on either a cash or an accrual basis’ and replacing these words with ‘must be prepared on a cash basis’.
3.5 At the end of clause 6.2(b)(ii) omit the word 'and'.
3.6 At the end of clause 6.2(b)(iii) omit 'roads.' and substitute 'roads; and'.
3.7 At the end of the note to clause 6.2(b)(iii) insert a new clause 6.2(b)(iv) as follows:
(iv) the amount certified by the Chief Executive Officer in the Chief Executive Officer’s financial statement as the funding recipient’s own source expenditure on roads is based on, and in agreement with, proper accounts and records.
3.8 In Part 1 of Schedule 1, insert the following after the table:
The own source expenditure on roads for (name of funding recipient) in 20xy-1z was: $.......
3.9 In the auditor's report section in Part 1 of Schedule 1, amend paragraph (iii) by omitting 'of roads' and substituting 'of roads; and'.
3.10 In the auditor's report section in Part 1 of Schedule 1, after paragraph (iii) insert the following:
(iv) the amount certified by the Chief Executive Officer in the Chief Executive Officer’s financial statement above as the funding recipient’s own source expenditure on roads during the year is based on, and in agreement with, proper accounts and records.
3.11 In Part 3 of Schedule 1, omit the following:
If the actual own source expenditure on roads at 1(a) exceeds the adjusted reference amount at 4(d), the funding recipient is complying.
