Fuel Quality Standards Act 2000
I, Don Farrell, Parliamentary Secretary for Sustainability and Urban Water, make the following determination under section 22A of the Fuel Quality Standards Act 2000.

1 Name of determination
This determination is the Fuel Quality Information Standard (Ethanol E85) Determination 2012.
2 Commencement
This determination commences on 1 November 2012.
3 Definitions
In this determination:
E85 means a fuel blend consisting of:
(a) 70–85% ethanol; and
(b) petrol that meets the requirements of the Fuel Standard (Petrol) Determination 2001.
service station means premises at which E85 is sold by retail from a fuel pump.
(1) The fuel quality information standard for the supply of E85 from a service station is that one of the following appears, clearly displayed, on any fuel pump at the station dispensing E85:
(a) the words ‘Contains 70–85% ethanol’, and ‘Not Petrol or Diesel’;
(b) the words ‘Contains x% ethanol’, where x is a number between 70 and 85, and ‘Not Petrol or Diesel’.
(2) For paragraph (1) (b), a number that is not a whole number is to be rounded to the nearest whole number, with a number ending with 0.5 being rounded up.
The fuel quality information standard for the supply, by retail sale, of E85 other than from a service station is that:
(a) before the E85 is supplied, the buyer is given a document that prominently includes the words specified in paragraph 4 (1) (a) or (b); or
(b) if the buyer is present when the E85 is supplied, the words specified in paragraph 4 (1) (a) or (b) appear on each container of E85 so that the words can easily be read by the buyer.
The fuel quality information standard for the supply of E85 to a retailer is that, at the time of the supply, the retailer is given a document that prominently displays:
(a) a statement that the E85 contains:
(i) 70–85% ethanol; or
(ii) x% ethanol, where x is a number between 70 and 85; and
(b) a statement that the E85 is the subject of this determination.
