Determination 2012/23
Remuneration and Allowances for Holders of Public Office
(i) Pursuant to subsections 7(3) and 7(4) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to certain holders of public office, and other matters significantly related thereto, and determines as set out below.
(ii) This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments unless otherwise specified.
PART 1 – FULL-TIME OFFICES
1.1 In this part, Determination Number 12 of 2012 (as amended) is referred to as the Principal Determination.
1.2 Part 2 of the Principal Determination is amended by deleting “26 January 2014” in Clause 2.2.11 and replacing it with “26 January 2015”.
1.3 Table 2A of Part 2 of the Principal Determination is amended by inserting the following entry after the entry for “Director-General, AusAID”:

PART 2 – PART-TIME OFFICES
2.1 In this part, Determination Number 13 of 2012 (as amended) is referred to as the Principal Determination.
2.2 The first page of the Principal Determination is amended by inserting in the section “This Determination comprises:” the following new schedule “Schedule F – Specified Offices – Annual Meeting Fee and Additional Daily Fees” after Schedule E – Aboriginal Land Councils – Fees and Allowances:
2.3 The Principal Determination is amended by inserting the following the following new schedule heading “SCHEDULE F – SPECIFIED OFFICES – ANNUAL MEETING FEE AND ADDITIONAL DAILY FEES” after the last entry of Table E1A of
Schedule E:
2.4 The Principal Determination is amended by inserting the following sentence, clauses and table after the Schedule F heading as follows:
General Provisions relating to the following table:
F1. Application: The office-holders specified in this Schedule shall be paid in accordance with the following clauses. For the purposes of Clauses F3 to F4 ‘business of the authority’ as defined at Clause 1.4, also excludes travel associated with attendance at a formal meeting.
F2. Annual meeting fee: The annual meeting fee is an annual fee payable on a periodic basis throughout each year. Part years are paid on a proportionate basis. The annual meeting fee covers all formal meetings, regardless of their duration, of the prescribed authority, including any preparation time and travel associated with the meetings.
F3. Additional daily fee: The additional daily fee specified in Table F1A is payable in respect of other business of the authority undertaken for periods of a full day, or more, of at least five hours on each day. For this purpose business of the authority includes sub-committee work and reasonable travel where it is not associated with a formal meeting.
F.4 Aggregation of hours for additional daily fee: An office-holder may also be paid an additional daily fee in respect of aggregates of periods of business of the authority of less than five hours, subject to the following conditions:
(a) individual periods of business must be for a minimum of one hour;
(b) to attract payment of an additional daily fee, aggregated periods shall total at least five hours;
(c) the maximum payment in respect of any one day shall be the additional daily fee; and
(d) eligibility for each payment shall be certified by the chairperson.
F.5 Annual cap: Payment of the additional daily fee to an office-holder may be subject to an annual cap where specified in Column 4 of Table F1A. No additional daily fees are payable where the accumulated daily fee earnings of the individual office-holder during a financial year reach the cap specified in Column 4 of Table F1A.
F.6 Additional clauses: The additional clauses referred to in Column 5, where applicable, are listed immediately following the Table.

Additional Clauses to Table F1A
F1A-1 IESC on Coal Seam Gas and Large Coal Mining Development: The Chair will receive an additional establishment loading of $20,000 per annum until 15 November 2013. Members will receive an additional establishment loading of $10,000 per annum until 15 November 2013.
2.5 Clauses 2.2 to 2.4 take effect on and from 9 November 2012.
