Customs Amendment (Maritime Powers Consequential Amendments) Regulation 2014

1 Name of regulation

This regulation is the Customs Amendment (Maritime Powers Consequential Amendments) Regulation 2014.

2 Commencement

Each provision of this regulation specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This regulation is made under the Customs Act 1901.

Customs Regulations 1926

1 After regulation 178

Insert:

178A Forfeited ships—prescribed Acts

(1) For paragraph 228(2)(c) of the Act, the following are prescribed:

(a) the Fisheries Management Act 1991;

(b) the Environment Protection and Biodiversity Conservation Act 1999;

(2) For paragraph 228(3)(c) of the Act, the Maritime Powers Act 2013 is prescribed.

2 Schedule 1AAD (table item 11A)

Omit “paragraph 185B(2)(b)”.

3 Schedule 1AAD (table items 11B and 14)

Repeal the items.

4 Schedule 1AAD (cell at table item 14A, column headed “is prescribed for this provision or these provisions of the Customs Act 1901 …”)

Repeal the cell, substitute:

subparagraph 186A(1)(b)(ii)

Repeal the item.
