Schedule 1—Amendments

Financial Management and Accountability Regulations 1997

1  Name of regulation

  This regulation is the Financial Management and Accountability Amendment (Public Governance) Regulation 2014.

2  Commencement

  This regulation commences at the same time as Schedule 2 to the Public Governance, Performance and Accountability (Consequential and Transitional Provisions) Act 2014 commences.

3  Authority

  This regulation is made under the Financial Management and Accountability Act 1997.

Note: The Financial Management and Accountability Act 1997 will be renamed as the Financial Framework (Supplementary Powers) Act 1997 by Part 1 of Schedule 2 to the Public Governance, Performance and Accountability (Consequential and Transitional Provisions) Act 2014.

4  Schedule(s)

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

 

Financial Management and Accountability Regulations 1997

1  Regulation 1

Omit “Financial Management and Accountability”, substitute “Financial Framework (Supplementary Powers)”.

2  Regulations 3 and 3A

Repeal the regulations, substitute:

3  Definitions

  In these regulations:

Act means the Financial Framework (Supplementary Powers) Act 1997.

3  Parts 2 to 5

Repeal the Parts.

4  Part 5AA (heading)

Repeal the heading, substitute:

Part 2Supplementary powers to make commitments to spend money and be involved in companies etc.

5  Subparagraphs 16(1)(a)(i) and (3)(a)(i)

Omit “public money”, substitute “relevant money or other CRF money”.

6  Parts 5A and 6

Repeal the Parts.

7  Part 7 (heading)

Repeal the heading.

8  Regulations 21 to 22AA

Repeal the regulations.

9  Parts 7A to 8A

Repeal the Parts, substitute:

Part 3Transitional and application provisions

 

23  Definitions

  In this Part:

amending regulation means the Financial Management and Accountability Amendment (Public Governance) Regulation 2014.

commencement time means the time when the Financial Management and Accountability Amendment (Public Governance) Regulation 2014 commences.

24  Commonwealth procurement and Guidelines

  Despite the repeal of regulations 7, 7A, 7B and 16A (which deal with Commonwealth procurement, and guidelines for Commonwealth grants, cleaning services and fraud) of these Regulations by the amending regulation, regulations 7, 7A, 7B and 16A, and any guidelines that are in force for the purposes of those regulations immediately before the commencement time, continue to apply after that time in relation to any process that is begun before that time.

25  Disposal of property found on Commonwealth premises

  Despite the repeal of regulation 23 (which deals with the disposal of property found on Commonwealth premises) of these Regulations by the amending regulation, regulation 23 continues to apply after the commencement time in relation to property found, or disposals that occur, before that time.

26  Transferring leave entitlements

  Despite the repeal of Part 11 (which deals with transferring leave entitlements when employees move between Agencies etc.) of these Regulations by the amending regulation, that Part continues to apply after the commencement time in relation to moves that occur before the commencement time.

10  Parts 9 to 11

Repeal the Parts.

11  Schedules 1, 1A, 2 and 3

Repeal the Schedules.
