I, TERENCE LINDSAY FARQUHARSON, Acting Director of Aviation Safety, on behalf of CASA, make this instrument under paragraph 28BA (1) (b) and subsection 98 (4A) of the Civil Aviation Act 1988, subregulations 5 (1), 207 (2), 215 (3), and 217 (1) of the Civil Aviation Regulations 1988, and regulations 11.160 and 11.245 of the Civil Aviation Safety Regulations 1998.

Civil Aviation Order 82.6 Amendment Instrument 2014 (No. 2)
This instrument is the Civil Aviation Order 82.6 Amendment Instrument 2014 (No. 2).
2 Commencement
This instrument commences on the day of registration.
3 Amendment of CAO 82.6
Schedule 1 amends CAO 82.6.
[1] Appendix 3, subclause 5.1
after paragraph 5.1 (a), insert
(aa) the pilot holds a Grade 2 NVIS endorsement and the NVIS positioning flight is a permitted NVIS grade 2 operation that is conducted in accordance with the approved risk assessment and operating procedures of the responsible NVIS operator; and
[2] Appendix 3, paragraph 23AA.2 (a)
substitute
(a) must be conducted by whichever of the following applies:
(i) if the operator has a TCO — an appropriately qualified and experienced person appointed by the TCO to conduct the NVIS CCF; or
(ii) otherwise — an appropriately qualified and experienced person appointed by a TCO to conduct the NVIS CCF; and
