We, the ministers, jointly declare that, under section 32 of the Mutual Recognition Act 1992:

 

The occupation which may be carried on only by a person granted registration (in the form of a licence, certificate, registration, or other instrument) in the first jurisdiction described in Column A in the attached Schedule is equivalent to the occupation which may be carried on only by a person granted registration in a second jurisdiction as described in the other columns of the same row in the Schedule, subject to any conditions, limitations or restrictions as indicated.

1      Name of Declaration

 This declaration is the Mutual Recognition (Equivalence of Gaming and Other Occupations) Amendment Declaration 2015.

 

2 Commencement

This declaration commences on the day after it is registered on the Federal Register of Legislative Instruments.

 

3  Authority

This declaration is made under section 32 the Mutual Recognition Act 1992.

 

4 Amendment to Mutual Recognition (Maritime and Other Occupations) Declaration 2009 (F2009L03219)

The Mutual Recognition (Maritime and Other Occupations) Declaration 2009 (F2009L03219) is amended as set out in Schedule 1.

4.                             Equivalent casino occupations

(1) Subject to subsection (2), the occupation which may be carried on only by a person granted a registration, in the jurisdiction, described in Column A of Schedule 1 (first jurisdiction) is equivalent to the occupation which may be carried on only by a person granted a registration, in a jurisdiction, described in the same row of Schedule 1 (second jurisdiction), subject to any conditions, limitations or restrictions indicated in Schedule 1.

(2) The occupation which may be carried on only by a person granted a registration, in the jurisdiction, described in Rows 2, 4, 7, 8, 10, 11, 13, 16, 19, 22 and 23 of Column A of Schedule 1 (first jurisdiction) is, subject to any conditions, limitations or restrictions indicated in Schedule 1, equivalent to the occupation which may be carried on only by a person granted a registration, in the jurisdiction, described in the same row of Schedule 1 (second jurisdiction), where the registrations issued by both jurisdictions authorise the same activity, or same combination of listed activities, below:

(a)       casino management;

(b)       casino executive management;

(c)       the conduct of gaming;

(d)       gaming machine;

(e)       keno gaming;

(f)         the maintenance, construction, or repair of gaming equipment;

(g)       the maintenance or repair of security and surveillance equipment;

(h)       the maintenance and support of computer systems in the casino;

(i)         the movement of money or chips about the casino (other than in relation to the supply of food and beverages);

(j)         the storage and exchange of money or chips to patrons in the casino (other than in relation to the supply of food and beverages);

(k)       the counting of money or chips in the casino (other than in relation to the supply of food and beverages);

(l)         cash and accounting (other than in relation to the supply of food and beverages);

(m)     internal audit operations;

(n)       the storage of gaming equipment in the casino;

(o)       casino promotions (if this is PR);

(p)       security operations;

(q)       surveillance operations;

(r)        administrative and incidental operations.

(3) For the purposes of subsection (2), where a registration issued by the first jurisdiction does not identify the activities authorised by the registration, the registration is deemed to authorise only the activities in fact carried out by the registration holder in the first jurisdiction.

5.                            Declaration not to limit powers of a registration authority

(1) Nothing in this Part is intended to affect the powers, under the Mutual Recognition Act 1992, of a registration authority in a second jurisdiction to impose conditions on a registration, other than conditions that relate to the activities authorised to be carried out under the registration.

7.  Declaration not to limit powers of a registration authority

(1) Nothing in this Part is intended to affect the powers, under the Mutual Recognition Act 1992, of a registration authority in a second jurisdiction to impose conditions on a registration, provided that the conditions imposed do not relate to the activities authorised to be carried out under the registration unless such conditions applied to the person's registration in the first jurisdiction.

Work conducted in relation to the assembly, positioning and detonation of explosives to break or dislodge rock and soil or to demolish structures, conduct seismic testing, or other special purposes. This work also includes:

-          Check blasting areas to ensure compliance with regulations, standards and other applicable licence conditions

-          Ensuring explosives are authorised, as per the competent authority, and within shelf life

-          Preparation of a blast management plan

-          Determining and maintaining the exclusion zone

-          Ensuring site security and safety prior to/during/after blasting (e.g. falling rock hazards, underground mine roof supports and harmful fumes)

-          Notify regulatory authority of an accident

-          Selection of suitable explosives and method of ignition for work proposed

-          Account for environmental impacts such as noise, overpressures, ground vibration, fly rock and air blasts

-          Preparation of charges and insert detonators and charges into holes properly charged, stemmed and bulled and charge underground blasts

-          Use of boosters

-          Decide quantity of explosives required

-          Implement warning procedures

-          Connect and test or inspect the blasting circuit

-          Fire charges

-          Inspect area to make sure all explosives have detonated

-          Treatment of misfired explosives

CR

The application of a pesticide in forestry situations.

NA

The application of a pesticide in or on a non-agricultural building (including domestic or commercial) or other structures. Codes for application methods

AA

The spraying, spreading or dispersing of any pesticide from an aircraft in flight. Includes baits.

FG

Fumigation means any treatment carried out with a fumigant. A fumigant is a substance that, when in a gaseous or vaporous state, is used to control or destroy pests.

GM

The ground application of pesticides by a machine or apparatus powered other than by hand - excluding application by an aircraft in flight or by fumigation.

HA

The ground application of pesticides by a hand held appliance (excluding fumigation). A hand held appliance includes a small portable spray that can be carried and operated manually.
