Determination 2016/01:

Remuneration and Allowances for Holders of Public Office, Judicial and Related Offices and Principal Executive Office

(i)                     Pursuant to subsections 7(3), 7(4), 7(4B) and 5(2A) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to certain holders of public office, and other matters significantly related thereto, and determines as set out below.

(ii) This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments unless otherwise specified.

PART 1 FULL-TIME OFFICES

1.1 In this part, Determination Number 21 of 2015 is referred to as the Principal Determination.

1.2 Table 2A of Part 2 of the Principal Determination is amended by replacing the figure in Column 3 of the entry for Chief Commissioner & Chief Executive Officer, Australian Skills Quality Agency with “$391,680” and replacing the word Agency with “Authority”.

1.3 Sub-clause 2.2.19 to Table 2A of Part 2 of the Principal Determination is amended by replacing the words “Australian Skills Quality Agency” with “Australian Skills Quality Authority”.

1.4 Clauses 1.2 and 1.3 take effect on and from 1 January 2016.

1.5 Table 2A of Part 2 of the Principal Determination is amended by deleting the entries for CEO Health Workforce Australia; Chief Executive Officer, ComSuper; Private Health Insurance Ombudsman; and the Coordinator-General for Remote Indigenous Services.

1.6 Part 2 of the Principal Determination is amended by deleting sub-clause 2.2.20.

1.7 Table 2A of Part 2 of the Principal Determination is amended by deleting “2.2.20” from Column 4 of the entry for “Chair, Australian Accounting Standards Board”.

1.8 Table 3A of Part 3 of the Principal Determination is amended by deleting the entry for Mr Timothy Wilson, Human Rights Commissioner, Australian Human Rights Commission.

1.9 Table 3B of Part 3 of the Principal Determination is amended by deleting the entry for Mr Timothy Wilson, Human Rights Commissioner, Australian Human Rights Commission.

1.10 Table 2A of Part 2 of the Principal Determination is amended by inserting the following entry after the entry for “Aged Care Commissioner”.

1.12 Table 2A of Part 2 of the Principal Determination is amended by removing the words “(DisabilityCare Australia)” from the entry for Chief Executive Officer, National Disability Insurance Scheme Launch Transition Agency.

PART 2 PART-TIME OFFICES

2.1 In this part, Determination Number 20 of 2015 is referred to as the Principal Determination.

2.2 Schedule B of the Principal Determination is amended by deleting sub-clauses B3.17 and B3.18 in the Additional Sub-clauses to Table B3.

2.3 Table B3 of Schedule B of the Principal Determination is amended by deleting “B3.17” from Column 5 of the entry for “Climate Change Authority Associate Member”.             

2.4 Table B3 of Schedule B of the Principal Determination is amended by deleting “B3.18” from Column 5 of the entry for “Australian Accounting Standards Board (AASB)”.

2.5 Table B3 of Schedule B of the Principal Determination is amended by deleting “B3.18” from Column 5 of the entry for “Auditing and Assurance Standards Board (AuASB)”

2.6 Table B3 to Schedule B of the Principal Determination is amended by inserting “B3.17” in Column 5 of the entry for Australian Competition and Consumer Commission – Associate Member.

2.7 Schedule B of the Principal Determination is amended by inserting sub-clause B3.17 to the Additional Sub-clauses to Table B3 as follows “Australian Competition and Consumer Commission – Associate Member (Agriculture): The office holder will receive an annual fee of $251,600 while working the equivalent of 3 days per week, administered in accordance with Schedule A of the Determination, in lieu of any amount appearing in Column 4.

2.8 Table A of Schedule A of the Principal Determination is amended by inserting the following entry after the entry for “Prime Minister’s Indigenous Advisory Council”.

2.14 Table 2 of Schedule A of the Principal Determination is amended by changing the wording of “Moorebank Intermodal Terminal to “Moorebank Intermodal Company Limited”.

2.15 Schedule B of the Principal Determination is amended by deleting the entry  “Pathology Services Table Committee” in Table B4 – Specified Professional Committees.

2.16 Sub-clause A9 of the Additional Sub-clauses to Table A of Schedule A of the Principal Determination is amended by replacing the second sentence with the following “The Hon. Michael Knight AO will receive $32,205 per annum member fee in lieu of other amounts specified in column 4 of Table A and whilst he is a member of the Audit and Risk Committee he is entitled to an additional $3,845 per annum for service on that committee, in lieu of any other audit fees that would otherwise apply under this Determination.”

2.17 Clause 2.16 takes effect on and from 10 March 2016.

2.18 Sub-clause A6 of the Additional Sub-clauses to Table A of Schedule A of the Principal Determination is amended by inserting the following sentence after the name ASC Pty Ltd: “This sub-clause does not apply to the Chair”.

PART 3 JUDICIAL AND RELATED OFFICES

3.1 In this part, Determination Number 18 of 2015 is referred to as the Principal Determination.

3.2 Sub-clauses 2.6.1 and 2.6.2 of Part 2 of the Principal Determination are amended by replacing ‘20’ with “18A” and ‘1976’ with “1975”.

PART 4 PRINCIPAL EXECUTIVE OFFICE

4.1 In this part, Determination Number 19 of 2015 is referred to as the Principal Determination.

4.2 Part 3 of the Principal Determination is amended by inserting sub-clause 3.3.1 after clause 3.3 as follows:

3.3.1 Where the Employing Body is satisfied that the workload and responsibilities of the office holder prevent the office holder from travelling to the principal place of residence for the purposes of family reunion, reunion travel by the office holder’s partner and/or a child or children of the office holder or partner, whose normal place of residence is the office holder’s principal place of residence, can be funded within the financial limits of the allowance. Travel by a person other than the office holder must be at economy class, and only for direct travel between the office holder’s principal place of residence and office location.
