This is the Export Control (Fees) Amendment (Tariff Rate Quotas) Order 2016.

(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority

This instrument is made under regulation 3 of the Export Control (Orders) Regulations 1982.

4 Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Export Control (Fees) Order 2015

1 Section 5 (paragraph (a) of the definition of export document)

Omit “or a government certificate”, substitute “, a tariff rate quota certificate or a government certificate”.

2 Section 5

Insert:

tariff rate quota certificate means a certificate that is issued under an order made under section 23A of the Act.

3 At the end of subsection 6(1)

Add:

; (o) goods in relation to which an application for a tariff rate quota certificate has been made.

4 Section 10 (table item 5, column 1)

After “export document”, insert “(other than a tariff rate quota certificate)”.

5 Section 10 (after table item 5)

Insert:

Assessment of an application for the issue of a tariff rate quota certificate for the export of goods (other than meat or meat products or milk or milk products)

For each tariff rate quota certificate applied for:

(a) if the certificate is not a replacement certificate and:

(i) the application is made using the Department’s electronic export documentation system—$15; or

(ii) the application is not made using the Department’s electronic export documentation system—$36; or

(b) if the certificate is a replacement certificate—$500

6 Section 10 (table item 6, column 1)

After “Provision of”, insert “any”.

7 Section 10 (table item 6, column 1)

Omit “5”, substitute “5A”.

8 Section 10 (before the note)

Insert:

Note 1: The assessment of an application for the issue of a tariff rate quota certificate for the export of meat or meat products or milk or milk products is covered by item 3 or 4 (see the definition of export document in section 5).

9 Section 10 (note)

Omit “Note”, substitute “Note 2”.
