Part 1Preliminary

1  Name

  This is the Norfolk Island Legislation Amendment Act Transitional Rule (Approved Pharmacists) 2016.

2  Commencement

  This rule commences immediately after Part 1 of Schedule 2 of the Norfolk Island Legislation Amendment Act 2015.

Note: Part 1 of Schedule 2 commences on 1 July 2016.

3  Authority

  This rule is made under item 357 of Schedule 2 of the Norfolk Island Legislation Amendment Act 2015.

Part 2Transitional rule

 

4  Approved pharmacists on Norfolk Island

 (1) This rule applies to a person who, immediately before the commencement of this rule:

 1. was a registered pharmaceutical chemist under the Pharmacy Act 1956 of Norfolk Island as continued in force under section 16A of Norfolk Island Act 1979; and

 2. carried on, or controlled the carrying on of, the business of a pharmaceutical chemist at particular premises (other than a hospital) on Norfolk Island.

 (2) For the purposes of the National Health Act 1953, the person is taken to be an approved pharmacist who was approved by the Secretary under section 90 of that Act for the purpose of supplying pharmaceutical benefits from the particular premises.

 (3) The approval is taken to have been given on 1 July 2016.
