Military Superannuation and Benefits Trust Deed

1  Name

  This is the Military Superannuation and Benefits Amendment (Trust Deed—ADF Super Consequential) Instrument 2016.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under section 5 of the Military Superannuation and Benefits Act 1991.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

 

Military Superannuation and Benefits Trust Deed

1  Subrule 51(1) of the Schedule

After “Subject to”, insert “subrules (1AA), (1A), (1B) and (2) and”.

2  After subrule 51(1) of the Schedule

Insert:

 (1AA) Paragraph (1)(c) does not apply to a person if he or she is either:

 (a) a member of the Permanent Forces; or

 (b) a member of the Reserves rendering continuous fulltime service.

3  Subrule 52(1) of the Schedule

Omitsubrules (2)”, substitutesubrules (1A), (2), (2A)”.

4  After subrule 52(1) of the Schedule

Insert:

 (1A) Subrule (1) does not apply to a person if he or she is either:

 (a) a member of the Permanent Forces; or

5  Paragraph 66(a) of the Schedule

Omit “subrules 51(4) and 52(2A)”, substitute “subrules 51(1AA) and (4) and 52(1A) and (2A)”.
