1  Name

  This is the Biosecurity (Movements between Parts of Australian Territory) Declaration 2016.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument

At the same time as section 3 of the Biosecurity Act 2015 commences.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under subsection 618(2) of the Biosecurity Act 2015.

4  Definitions

Note 1: A number of expressions used in this instrument are defined in the Act, including the following:

(a) affected provisions;

(b) Australian territory;

(c) conveyance;

(d) goods;

(e) protected zone area.

Note 2: A reference to Australian territory includes Norfolk Island on and after 1 July 2016.

  In this instrument:

Act means the Biosecurity Act 2015.

Torres Strait permanent biosecurity monitoring zone has the same meaning as in the Biosecurity Regulation 2016.

5  Regulated movements between parts of Australian territory

  Subdivision B of Division 2 of Part 4 of Chapter 11 of the Act applies to movements that:

 (a) are of a thing specified in column 3 of an item in the following table; and

 (b) are from a part (the origin part) of Australian territory specified in column 1 of that item; and

 (c) are to another part (the destination part) of Australian territory specified in column 2 of that item.

(c) a vessel that is longer than 7 metres, and is intended to be moored at a port in the destination part specified in column 2 of this item

Note 1: The provisions (the affected provisions) of the Act listed in section 619 of the Act apply as described in Subdivision B of Division 2 of Part 4 of Chapter 11 of the Act, subject to the exemptions provided by section 118 of the Biosecurity Regulation 2016 and section 6 and subsection 7(3) of the Biosecurity (Human Health) Regulation 2016 in relation to an actual or intended movement (however described) of goods or a conveyance described in this section (see subsection 618(1) of the Act).

Note 2: Notice may not need to be given under section 120 of the Act in relation to goods that are, or are intended to be, brought from the origin part specified in column 1 of item 9, 10 or 11 in the above table (the relevant item) to the destination part specified in column 2 of the relevant item (see section 16 of the Biosecurity Regulation 2016).

Note 3: The operator of an aircraft or vessel that is intended to enter, or that enters, the destination part specified in column 2 of an item in the above table (the relevant item) from the origin part specified in column 1 of the relevant item may not need to give a report under section 193 of the Act (see sections 50 and 51 of the Biosecurity Regulation 2016).

6  Application of this instrument to Norfolk Island

 (1) Items 7 and 8 of the table in section 5 of this instrument apply on and after 1 July 2016.

 (2) This section is repealed at the start of 2 July 2016.
