National Disability Insurance Scheme Act 2013

I, CHRISTIAN PORTER, Minister for Social Services, make these Rules for the purposes of sections 22, 23 and 209 of the National Disability Insurance Scheme Act 2013.

1 Name of Rules

  These Rules are the National Disability Insurance Scheme (Becoming a Participant) Amendment Rules 2016 (No. 2).

2 Commencement

  These Rules commence on the day after registration.

3 Amendment of National Disability Insurance Scheme (Becoming a Participant) Rules 2016

  Schedule 1 amends the National Disability Insurance Scheme (Becoming a Participant) Rules 2016.


Schedule 1 Amendments

Item 1 Paragraph 8.4, definition of 2016 NDIS early transition areas

Omit the definition

Item 2 Schedule A, Queensland  

Omit:

The effect of this table is that a person who resides in Townsville or Charters Towers from the day after this instrument will be registered will meet the additional residence requirements but will only meet the additional age requirements if they were under 18 on 1 April 2016.  A person who resides in Palm Island will meet the additional age and residence requirements from the day after this instrument will be registered.

Substitute:

The effect of this table is that persons in Queensland are eligible to become participants depending on where they live and, in some cases, how old they are.  Schedule B defines the boundaries of particular districts mentioned in column 1 of the table.

Item 3 Schedule A, Queensland  

Omit the table, and in its place insert:

After the table, insert the following text:

From 1 July 2016, the additional age requirements in the first row of the table cease to apply.
